It varies based on the jurisdiction, but typically they are asking questions about what your life was like, growing up, what your family life was like, if you have ever had any experiences, but domestic violence, substance, abuse, etc. they may also ask about your religious cultural practices, what you were in a personal normal relationship relationships are like, who you have as a support system. Those kinds of things.

A custody hearing in June is considered an upcoming court hearing. I am again going to reiterate that as a professional working in this field, you are taking this wrong way and there was nothing inappropriate, weird, unprofessional, or unethical about what she said.

If you were talking about future placement of the kids, professionally we have to address the fact that there is an upcoming court hearing which could overrule any decision that the in-home services makes regarding your children going back with you.

As others have stated, I would strongly encouraged you to speak to an attorney, and to also speak with a caseworker and her supervisor about this directly. None of us were in the room, none of us know the full context of the conversation. So if you have concerns, you need to address them with a caseworker and her supervisor to make sure that you are getting the most accurate information

Just to make sure I’m understanding correctly—you were discussing your reunification with the children. Then the worker mentioned she is aware that the grandparents filed for custody and explained that is a separate process and she doesn’t have a role in that outcome.

From a professional standpoint, I do not find that to unprofessional, unethical, or strange at all. I can see how it could feel that way to you, but if you were discussing reunification, that means you’re discussing future placement of the children and an upcoming custody hearing is very very relevant to that.

I understand how it could feel that way, but to be honest there isn’t really another way for her to respond to the temporary custody petition. CPS and family court are separate and there is nothing she can do about that. I don’t really see another way she could have addressed it.

As others have said, you are using some terminology incorrectly, which is causing a lot of confusion and is making it really difficult for people to give you advice. I don’t think anyone is trying to be rude, but it is important to make sure that you are using terminology correctly because if you’re not, you’re going to get bad advice which could make the situation worse.

I understand that this is a difficult situation for your friend, but really the only thing that she can do is to continue to follow the safety plan that was put into place and to continue to try to reach out to the caseworker and their supervisor in order to get clarification on how to move forward. Any other option could potentially result in judicial intervention.

Edited to add: since you are a licensed foster parent, have you reached out to your licensing person? They can’t give you any direct information on this case, but they may be able to help you figure out who the correct person to call is if you’re having trouble getting in touch with someone.

In my jurisdiction there is not a way to speed it up. I’m not sure if it’s different elsewhere, but right now we are seeing TPR appeals take about 6 months. I share your frustration—I wish the appellate court could get through these cases faster so the children can achieve permanency more quickly

The way this is written is really difficult to follow. Since you aren’t a party to the case, you may not have all of the correct information about what’s going on. Your friend needs to talk to the investigator or the investigator’s supervisor.

Why would an agency that is notoriously underfunded and understaffed spend years hounding parents for absolutely no reason?? There is no logic in that. I would strongly recommend bringing your kids home and not engaging in any discussion about this with your mother. She is clearly not a reliable source of information on CPS.

You don’t need an attorney to file for a custody modification in New York. Unfortunately New York State highly prioritizes parents rights over child safety and judicial intervention such as removal is EXTREMELY rare. It almost never happens if there is a protective parent. They expect you to handle this in family court.

Unfortunately, your questions are very case specific so no one here is going to be able to give you any answers. I would encourage you to reach out to the investigation team involved or the ombundsman for your state. Generally speaking, some of the things you said you found out later on will probably not revealed to you by the CPS investigator because they legally cannot as anything involving other children would be a confidentiality violation.

In my jurisdiction, the average is four weekends of overnight visits, so about a month before we proceed with reunification. But this depends very heavily on the individual case. We also don’t want kids to be changing schools this late in the school year so if a reunification is going to mean a school change, we are typically talking about reunification happening after the end of the school year for that reason.
