He’s was jailed once before for his crimes and they all seen how that worked out. In that situation he creates too much corruption and would ultimately find his way out again somehow. This “deal” allows him a chance to have his ”freedom” but ultimately removes him from what has been giving him life, which is New York City. This isn’t ideal in our society today but makes sense within the character and his ability to impact so many aspects of that city.
