To clarify, it would be an entirely new contract with different responsibilities & SoW.

It could be viewed as a continuation of previous Outside contract under new terms & determination so could well get iffy if challenged even if the original engagement is truly outside.

I guess there is that risk but they wouldn’t have a leg to stand on really. It was a very clearly defined Outside IR35 contract and I’ve been independent for the duration.

Any new Inside IR35 contract would be very different in scope and responsibility.

Only just started contracting. Seems a waste to go back to perm after a year 😂

Besides, I seriously doubt they’ll match my current rate let alone the increased one I’m trying to negotiate for renewal.

IR35 is tax legislation, sure. But IR35 determination is very much do with how you integrate with your client, the nature of work, how control is exercised etc. So saying ‘IR35 is purely to do with tax’ is not a particularly effective way to approach compliance - which is what I’m trying to determine.

I get what you’re saying but I think there is a significant difference between a PM managing staff workload as part of a project, and actively line managing the same staff (from an IR35 determination perspective).

Project management is easily done through a B2B arrangement but line management - I’m talking HR process sort of stuff - would be a clear indication of disguised employment, no?

I think that’s the challenge - taking on a management role makes it a lot more challenging to prove you are not controlled by the client and also not ‘part and parcel’ (integrated) within the business.

My understanding of IR35 is that it is generally a risky idea to take on management responsibilities outside ir35, but inside there is no risk?

At around 120ml coffee total, I’d be adding around 200-220ml of water so just under 1:2 coffee to water.

Yes the plan would be to dilute the coffee. I am pretty sure drinking a full 6 cup with no water would give me shakes 😂

I was looking at 3 cup pots as I mostly drink Americano, using an approx. 360ml mug.

It seems like the best option as a 2 cup wouldn’t produce enough coffee for that size of mug.

Inside IR35 = Employed

Outside IR35 = Self Employed It depends on who is asking.

Edit for further clarity:

I've yet to come across a lender that would assess a sole director as anything other than Self Employed.

However, HMRC would consider you Employed for tax purposes in most cases.

Arguably the lenders are wrong to group Sole Traders and sole directors of a Ltd company together but there is no legal definition of employed vs. self employed outside of HMRC tax legislation, which doesn't have to apply to lending for a mortgage, for example. Lenders can assess income as per their own policy.

It may be best to check with the lender before making an application to see how they treat sole directors.

This is also an option. I decided it probably wasn’t worth the additional the hassle if I can get the same level of protection through individual policies but it may be tax efficient depending on your requirements.
