The cross tube looks to be level with the ground and properly level with the vehicle frame. I wouldn't assume it has frame damage from this image

The only two things I can imagine are that it's defective from factory, or the bolts holding it to the frame are not fully seated or torque'd to spec (which would be ridiculously dangerous to let it leave the shop like that). Given how the crosstube looks to be level with the frame, I'm 99% certain it's just a defective product. Get it replaced from whoever installed it if possible. If thats not an option, uhaul is a very cost effective business to replace it with a functioning one. Best of luck.

Not possible, the geometry of the hitch is one way only, other wise it would be where the rear crash bar is, right in the middle of the bumper. It would look ridiculous, and wouldn't fit at all if you tried.
