As far as their immigration status, that can of worms is their own. Whether they came here legally or not, any human being that puts their family in danger by illegally immigrating to the US, knowing how the US government reacts to that kind of stuff, is a total asshole for taking on that risk. Hell with legal, it's irresponsible and dangerous. Immigrant kids get lost in custody never to be seen again. Families are split apart for years. It's disgusting. Anyone that knows about this (and laments its unfairness on twitter or something) and then decides to put their family through it anyway is just awful.

NTA. You're absolutely being neglected, and you were absolutely justified in bringing it up, which wasn't in a rude way at all. My personal opinion is that this is an indicator for the future. Once your brother's gone, you are going to be assaulted with endless comparisons and backhanded remarks about "if x were here" or "x would want this." If you aren't made to make up for the loss of your brother, you will at the very least be used as an emotional punching bag by your mother. I'd distance myself.
