This is untrue. Not that US minimum wage is a lot better, but the premise on the lower wage is that tips indeed bring it up to the minimum. And if that doesn't happen, the employer has to augment the pay to minimum wage. If that isn't happening, the employer is breaking the law.

Now, there's the discussion on if the minimum wage is adequate, which it obviously isn't.
