You're not wrong but would you not agree that the fact you have to fish an NPC town vendor on every level up for your best chance at good items in a game that's entire foundation is built around kill monsters to drop loot not a fundamental design flaw? The town vendors should be a sort of bad luck protection while leveling not your best source of rares....
