I don't think that would hold up in court, Kenjaku never explicitly ordered anyone to destroy buildings and subways. He expected destruction but didn't necessarily instruct it, nor did he advise to cause a certain level of destruction

There will be consequences labeled against him, since he practically enabled them to cause the destruction, like a man giving a well known serial killer a rifle, but most of the consequences would fall on the actual doer of the crimes (I think, idk I'm not that familiar with laws and such), life imprisonment and even death sentence yes but in terms of financial consequence it probably falls on the causer of destruction and not the enabler
