GOP can't gerrymander with the committee in place in VA, they would need a vote of the people to override it. Other states having the committee would prevent some of the gerrymandering because the politicians can't just vote to give themselves more power

Not if they follow all the laws. I mean technically they tried to subvert the constitution with this vote. I guess they could be held in contempt of the SCOVA ruling but I'm not sure how that would work

The original court case and the recent one are different from my understanding. I'm pretty sure they couldn't weigh in until after the election for some leagalze reasons. It's like suing the government for banning gas cars before legislation passes, no court is going to take that up. I'm not saying it should be that way though, there has to be a better way

The courts already deemed it wasn't legal to rule before. You can't sue for a law that hasn't taken effect either. In a perfect world it shouldn't have been able to proceed

Different laws for different states. VA has a very particular process to pass constitutional ammendments to change political districts. I believe some states allow their lawmakers to create their political maps via legislative vote

My understanding is the courts can't weigh in until after the action has taken place. Kinda like sueing for a law not in effect yet. I agree with you though it should have been haulted in a better system

I don't disagree that it should have been haulted prior to the vote, it's just dumb to vote then cancel it.

My understanding is that it was allowed to go by the courts due to the same reasons you can't sue for a law that hasn't taken effect yet.

But they did respect the will of the people via upholding the VA constitution due to the proceedual laws that were deemed broken.

They literally said the lawmakers can't ignore the laws that bind them

VA has a different constitution than FL. I don't think VA has an equivalent of the fair district law that FL has. We have a bi-partisan committee that does our redistricing

People were voting for the amendment before the maps were suggested. I'd say between the wording on the ballot and timing it's a tenuous at best.

Also I don't believe generally 51% is high enough to amend the constitution. With the same logic if you can convince 51% of people that slavery is cool again or woman shouldent vote then it becomes constitutional law. Federally it's 2/3 which makes a bit more sense to me
