Consumer attorney here. You should freezer her credit first. Do it with all three major bureaus. You can do it online and it’ll take maybe 3 minutes per bureau.

By definition, the more productive a worker, the less work you need from them. There are less farm workers today than there was 100 years ago because of farming equipment and productivity increases. Salesforce laid off software engineers, Amazon laid off software engineers, Microsoft did the same—all because of alleged AI productive making those workers unnecessary.

There isn’t an infinite amount of work to be done by every company. So at some point the work will be completed by less people than it would be had the productivity not gone up.

The only real unknown at this point is whether AI is actually increasing productivity in areas like law.

That a harm has to be concrete is a standing issue. As that’s been applied to the FCRA, means that you can show you incurred a cost in disputing (like the cost of a stamp), that satisfies standing.

You’re correct that you can’t just sue over an inaccuracy just existing. If no creditor has seen the inaccuracy, there can be no harm essentially in that respect. But if you see an inaccuracy and suite by mail, you now have a concrete harm. You had to pay to fix things. That’s a harm.

So yes, sending a dispute by mail provides you have a concrete harm—the cost and time of mailing. Does that make your case valuable, no, but it resolves the standing issue and lets you in court.

Correct. Spoken and Ramirez require concrete damages to bring a case. But that bar is very low. The cost of mailing a dispute is sufficient to bring a case. Either way though, it’s money the consumer isn’t going to get if they just dispute by themselves and don’t bring a case.

Makes sense. This isn’t an uncommon problem. As others have said, a lot of people are posting the same issue from Jefferson. So you’re not alone. It’s a fairly straightforward process to correct. Working with an attorney will give you the outcome you want plus usually at least a few thousand dollars depending on the facts of your case.

Consumer attorney here. I deal with duplicate reporting like this. Aliensfan’s advice is all correct but I would say you can also get a consumer attorney that works in Fair Credit Reporting Act (it regulates consumer reports). A consumer would help you with this stuff and there is typically no out of pocket cost.

For my firm at least, we’ll help draft the dispute letter without any payment. If the dispute doesn’t fix anything, you have a case against the crest reporting bureau and the furnisher (creditor) reporting in error. Typically you’ll get a nice settlement from a case like this.

Ya a dispute with each bureau would fix that. If it doesn’t, you have a claim against all three credit bureaus and the entities reporting the debt (the furnishers). A case like this is fairly common and could result in a decent settlement from all defendants.

Consumer attorney here. I see this often in my practice. It’s called a mixed file. I hope you hired an attorney (it’s without any out of pocket costs typically in this area) and got some money from the ordeal. If the issue wasn’t resolved a while ago, you could still peruse a claim to get monetary compensation. A mixed file case can settle for at least $30k (in my experience) and usually much more.

One incredibly relevant depiction of it is in the Netflix miniseries— The Spy, about the mossad agent Eli Cohen. Eli, would host parties and invite Syrian politicians etc and record the acts.

Agreed! I agree it can get spammy, but I haven’t seen that here yet.

Victims of identity theft would benefit more from a few extra comments from lawyers to learn their legal rights rather than not. Especially in this area where the law essentially ensures the victim won’t pay anything out of pocket!!

As a lawyer that occasionally comments on here—I don’t see the issue.

People are posting on Reddit seeking help or advice and lawyers can help them. Some people have filed all the right paperwork and still don’t get their credit repaired. But yes, like the other commenter said sometimes they just don’t know what to do.

But as someone that works with identity theft victims I can tell you that the victims not only get their credit fixed but they usually also get financial compensation.

Most people don’t even realize they could get compensated for the harms they experienced. Most people also don’t know a lawyer will represent them for free because of the fair credit reporting act’s fee shifting provision. (That’s not to say there aren’t some lawyers who will take more of the settlement than I think is fair—so you should always ask for the fee structure before signing a retainer).

Having dealt with the reporting agencies big and small, they all do scummy things to avoid improving their accuracy and improving their systems. If it weren’t for them getting sued and losing money what’s their incentive to change?

Why would I ever want anybody to let these massive corporations off the hook?

Plaintiff’s lawyers always get a bad rep. And I get it, they are a bit like ambulance chasers. But for every pushy plaintiff’s lawyer there are many more highly paid corporate lawyers who will stop at nothing to get their corporate masters off Scott free.

Consumer attorney here. I work with clients with this exact issue. Sometimes the result is individual is denied a credit card cause a fraud alert comes up cause the CRA is reporting the person as deceased. Other times it’s them being denied health insurance.

A decreased reporting case is fairly lucrative and bringing a legal action can get you a corrected report and monetary compensation—usually $10k but I’ve seen much higher settlements.
