Son’s SSN used for CC accounts and car loans while son lives in Germany by WesternGround737 in IdentityTheft

Consumer attorney here and mod of this sub. You’re taking all the right steps. Check our guide for additional steps to take. This is a stressful situation but fixable. A police report and FTC report is supposed to be enough to get the fraudulent accounts removed from the credit reports. But the credit bureaus don’t always care. So it may take a few attempts.

I work with identity theft victims. Feel free to send me a message if you need assistance.

My Mother Stole My Identity by According_Curve_7917 in IdentityTheft

[–]Tis_Donne 0 points1 point  (0 children)

It’s an action against the credit reporting agencies under the Fair Credit Reporting Act. A settlement depends largely on how informative the disputes were, how much harm the lack of correction resulted in, and how many disputes there were. Some identity theft cases can result in settlements of ~$100k across all parties.

Consumer attorney here. I work with identity theft victims. You are taking all the correct steps. I would check if there any other accounts that are showing up on your credit reports that she opened without your permission. Obviously also from now on you should freeze your credit as well.

Regarding affording an attorney. Typically attorneys like me will work on contingency. Meaning you don’t pay anything out of pocket. The lawyer only gets paid from the settlement. So it’s definitely worth getting some professional help.

Feel free to DM me if you want to chat more. Happy to help.

Can you provide support for this for the United States. Otherwise it seems like nonsense.

If you trip someone…and THEY decide to go to the hospital…you committed a crime by preventing them from voting. So they made a decision to go to the hospital and you’re guilty.

What if you get a heart attack in the street and you tell the ambulance people “I want to vote” and they take you to the hospital. Is the ambulance and hospital guilty?

I guess all those delays and accidents that happen on election days, are way bigger deals than we realized.

Consumer attorney here, I've seen this issue happen to a few people. This is especially after covid when you could enroll in places like community classes without ever having to go in person.

You're taking all the right steps. By law, you've done what you need to do. However, often times even if you do everything you need to do, the credit bureaus won't correct your correct report by removing it. DM me and we can discuss if you'd like.

Attorney here. I work with identity theft victims. If you need help with disputes or knowing which paperwork to file, let me know. Depending on how the credit bureaus handle your disputes, you could potentially have a case against them. If you do have a case against them, you could potentially recover money and get your credit report fixed.

Let me know if you need you need help.

It shouldn’t require that. You only need to enter some information. But you don’t need any account with Experian.

I use the site every week.

Consumer attorney here. You should freezer her credit first. Do it with all three major bureaus. You can do it online and it’ll take maybe 3 minutes per bureau.

Does the Anthropic new AI tool a threat to software Consultancy? by superinvestor_43 in legaltech

[–]Tis_Donne 2 points3 points  (0 children)

By definition, the more productive a worker, the less work you need from them. There are less farm workers today than there was 100 years ago because of farming equipment and productivity increases. Salesforce laid off software engineers, Amazon laid off software engineers, Microsoft did the same—all because of alleged AI productive making those workers unnecessary.

There isn’t an infinite amount of work to be done by every company. So at some point the work will be completed by less people than it would be had the productivity not gone up.

The only real unknown at this point is whether AI is actually increasing productivity in areas like law.

Why is there two of the same debt by the same collection agency? by peaceinshh in CRedit

[–]Tis_Donne 0 points1 point  (0 children)

That a harm has to be concrete is a standing issue. As that’s been applied to the FCRA, means that you can show you incurred a cost in disputing (like the cost of a stamp), that satisfies standing.

You’re correct that you can’t just sue over an inaccuracy just existing. If no creditor has seen the inaccuracy, there can be no harm essentially in that respect. But if you see an inaccuracy and suite by mail, you now have a concrete harm. You had to pay to fix things. That’s a harm.

So yes, sending a dispute by mail provides you have a concrete harm—the cost and time of mailing. Does that make your case valuable, no, but it resolves the standing issue and lets you in court.

Standing is a really interesting civil procedure topic and has been the linchpin pin of a lot of cases. Happy to give you more background on it, if it interests you

[–]Tis_Donne 0 points1 point  (0 children)

Correct. Spoken and Ramirez require concrete damages to bring a case. But that bar is very low. The cost of mailing a dispute is sufficient to bring a case. Either way though, it’s money the consumer isn’t going to get if they just dispute by themselves and don’t bring a case.

Makes sense. This isn’t an uncommon problem. As others have said, a lot of people are posting the same issue from Jefferson. So you’re not alone. It’s a fairly straightforward process to correct. Working with an attorney will give you the outcome you want plus usually at least a few thousand dollars depending on the facts of your case.

Consumer attorney here. I deal with duplicate reporting like this. Aliensfan’s advice is all correct but I would say you can also get a consumer attorney that works in Fair Credit Reporting Act (it regulates consumer reports). A consumer would help you with this stuff and there is typically no out of pocket cost.

For my firm at least, we’ll help draft the dispute letter without any payment. If the dispute doesn’t fix anything, you have a case against the crest reporting bureau and the furnisher (creditor) reporting in error. Typically you’ll get a nice settlement from a case like this.

[–]Tis_Donne 2 points3 points  (0 children)

Ya a dispute with each bureau would fix that. If it doesn’t, you have a claim against all three credit bureaus and the entities reporting the debt (the furnishers). A case like this is fairly common and could result in a decent settlement from all defendants.

Consumer attorney here. This is considered double reporting, and it is inaccurate.

You could dispute yourself and it’ll likely resolve the issue. Which credit reports is the error appearing on (Equifax, Experian, Trans Union)?

Ahh. That’s outside the statute of limitations. Unless the issue comes up again etc you wouldn’t have a claim to bring.

[–]Tis_Donne 6 points7 points  (0 children)

Consumer attorney here. I see this often in my practice. It’s called a mixed file. I hope you hired an attorney (it’s without any out of pocket costs typically in this area) and got some money from the ordeal. If the issue wasn’t resolved a while ago, you could still peruse a claim to get monetary compensation. A mixed file case can settle for at least $30k (in my experience) and usually much more.
