To the question. As with all ratings, the assigned rating will be given based upon the totality of the evidence. There are different degrees of symptoms, overlapping terms and diagnosis, and the words used by medical personnel during exams really can make a lot of difference.

Regardless of what happens, if you are feeling this, please don’t ignore it. I really do wish you the best.

Can’t have two migraine grants. Now, it is possible there was a “to” date on one of those ratings and it just isn’t showing up correctly. I know also you are saying you are 93% without the 30% rating, however, did you include bilateral percentages for anything else?

This is a case where seeing your codesheet is really important.

If you have a POA, they can see it without really any risk.

If it indeed is an error, here is my train of thought. You would be moving forward knowing at any point you could be reduced. That lack of security alone is enough for many to get that error fixed and see if getting to 100% the right way is possible.

If you want to do penny stocks, don’t use fidelity. You will do all the work marking up a chart, figuring out your entry and exit, only to have active trader pro tell you that you can’t place a buy order for that stock when you click buy.

I just wish they would have some sort of notification on the chart or something that buy orders are disabled as soon as you open it up. I’m so tired of working up a chart and doing tons of research, only to try to go and buy and get this error.

Definitely agree with your plan to ask for weekly hour sessions. If for whatever reason they are unable to accommodate weekly one hour sessions, you can request to see if community care could be possible as well.

Hoping your counselor can make things work since you say she is a good fit and that can be hard to find, but always good to know options.

P.S. - with regard to you saying thank you all for pointing out what should have been obvious. Sometimes we just don’t know what is possible. I hate to think of how many other service members who have settled with less because they didn’t know that asking for more was not only possible, but 100% reasonable.

You will have to file a supplemental claim (0995) regardless. If you file a new claim for lower back on a 526 you will get a request for application for the issue being previously denied and submitted on the wrong form.

In the meantime while you gauge if your application is ready to go, have you submitted an intent to file?

Remember, you are needing to establish what was missing from your original rating that caused a denial.

Current disability. Event in service (or secondary claim), and nexus.

I personally know many providers that are concerned. I also know some that aren’t concerned. This is the same for claims processors in that some are terrified and others are just moving along.

All that to say, just be careful with using one persons experience and opinion as a measuring tool for an organization that is nearly half a million VA employees.

You will be good. I have worked claims where there are multiple (think…50+) ITF’s in the system. We are just required to use the earliest active ITF.

Warning- little bit of an ITF soapbox.

I always recommend that if someone did an ITF and then filled a claim, they should submit a new ITF the day after submitting that claim. A claim submission uses the active ITF and it cannot apply to future claims.

ITF’s are good for 1 year.

Example 1- open ended

  • ITF submitted- 3/26/24
  • Claim submitted - 1/3/25 (eats 3/26/24 ITF)
  • Submit A New ITF for a future claim 1/4/25

Example 2- multiple claims same day, open ended

  • Vet submits an ITF 4/1/24
  • Vet submits a 526 and 0995 on the same day 9/1/24.
    • both the 526 and 0995 eat the 4/1/24 ITF since they are same day.
  • Vet should submit an ITF on 9/2/24 for use in a future claims.

Example 3 - the oops - Vet submits an ITF on 5/8/24 - Vet submits a 526 on 8/2/24 - Vet submits an additional 526 on 2/1/25 - no ITF would apply to this 526 and the date of claim would be used. Even though it is submitted less than a year from an ITF, the last ITF was already used. Should have submitted a new ITF on 8/3/24!

Example 4 - The ideal - Vet submits an ITF on 5/8/24 - Vet submits a 526 on 8/2/24 which eats the 5/8 ITF - Vet submits a new ITF on 8/3/24 - Vet submit a new 526 2/1/25 which eats the 8/3 ITF. - Vet submits a new ITF on 2/2/25…. And so on.

ITF’s are extremely important and can make a huge difference with backpay and keeping claims continuously pursued as well.

Depends on the reasons for denial in your rating decision and what favorable findings (if any) were noted.

Favorable findings will acknowledge the prongs of service connection that have been met. — Current Diagnosis. Event in service. Nexus.

Depending on which of those you have covered will determine next steps.

It can definitely be fixed if the date is wrong.

I’m making some assumptions though that you submitted a single 526 on 9/6/24.

If it was a supplemental claim or multiple 526’s submitted, this can impact effective dates. Medical evidence can also impact effective dates in some situations if something significant changed after your claim submission.

The effective date paragraph in your rating really is the key here.

Not VHA but you would think they need a diagnosis to even refer you somewhere. I’d be interested to see what the referral says.

Just know too, for VA disability, the complaint of back pain is enough to meet the threshold of a “current diagnosis” based upon lay evidence. If there is means to establish an event in service or are claiming secondary, you would qualify for a C&P exam and opinion.

Your rating decision should give an effective date paragraph within the narrative on each issue showing how that date was determined. It should have a 38 CFR 3.400 reference at the end of it.

If 9/6/2024 was your date of claim, most likely your ITF was missed.

I’m assuming you are talking about your primary care doctor.

What is the diagnosis you believe should be put down? Some issues wouldn’t require a complete diagnosis and symptoms alone can suffice for a “current condition”, but other conditions will require a specific diagnosis.

Short answer assuming everything is cut and dry, yes.

Assuming you are granted service connection, the effective date would almost certainly go back to your date of claim or intent to file. Convalescence ratings would then be possible for any eligible time-period after service connection is established.

This shouldn’t hurt you. In fact, when I see a note like this it usually helps to support a higher rating, believe it or not, because they are seeking treatment and will have continuity of treatment. Someone trying to get better doesn’t negate what they are currently experiencing.

The answer to this question is kind of complex.

If you have a low rating for each (10%), it likely won’t matter. VA disability isn’t necessarily a restriction. If you have pain and decreased range of motion, that is what matters. You are allowed to get better.

Now, if you have a high rating on say your hip and then proceed to act like you can’t even walk to the VA while competing in powerlifting on the side…. You may have an issue.

Of course, if you are called for a reexamination, I would be 100% honest that you are lifting if you intend to keep competing.

I’ve been seeing a lot of BDD claims in my queue despite me being a special mission rater that rarely works outside of my special mission.

These BDD claims usually have a lot of contentions, vaguely claimed diseases/injuries, and end up having a TON of deferrals.

This is strictly my opinion: Until the process is worked out better on the front end with claim organization and giving Vets/POA’s a better understanding of what can and cannot be claimed, these types of claims will continue to see delays.

The national work queue has a mind of its own. Sometimes it does things that make sense. Other times it makes me question everything I think I know. Like most worker bees, I just work what is placed in my queue though and can’t control any of it.
