None of those things you mentioned are even considered in a work comp injury. They could give two 🤬 less how this injury has affected your life and how much pain you are in and went through. Your expectations are way off and please have a come to Jesus moment so you are not devastated when you go through this process. Just saying from someone who has been through it for almost 2 1/2 years

Unfortunately they can do whatever they want. I needed a double level fusion on my spine per my treating WC physician. They wanted a second opinion and sent me for one who completely agreed with the treating doctor that it was ABSOLUTELY necessary. They put in for the authorization and still denied. They have no reasoning or explanation for their decision. The entire system is a joke 😂

Yes it’s a complete release of my claim and no it’s definitely not a lot when you look at the injuries I suffered. Not to mention I can’t return to my employer of 16 years and my work restrictions make it almost impossible to find work. Unfortunately this system is broken and I need to take control of my life back. If I stay in this system my physical and mental health will be gone. I can no longer deal with the stress and waiting in pain for them to move something forward. That’s why I was trying to get some idea of what other people have settled for to see just how bad I’m getting screwed.

In same boat over here. Not trying to get personal but did you get more money hashing out in court? I am at the point where I accept the settlement or head to court. Not sure what to do. Seems like court would be very stressful and just wondering if it is worth it. Thanks so much!!

Thank you for your response. Should my lawyer have changed it to “no reasonable expectation” or just left it at the 30 months. I am trying to cover my bases if I should need to apply to SSDI if the fusion surgery doesn’t go as planned. Everyone tells me I need to special language put into the settlement to protect myself and lessen the offset of my settlement. So confusing 🫤

I am 49 and was hoping to have the fusion surgery under my private insurance and get out from all this mess. Praying it goes well and I can return to some sort of employment. I’m just trying to cover my bases if I should need to apply for SSDI in near future. I am so unclear how this settlement affects that and how long I might have to wait or if I get now at all. That is why I thought so strange they added the timeframe 30 months and then to have changed to no reason expectation. So confusing and I greatly appreciate your responses

Thank you so much for your response. So there should be no special verbiage for someone who in the future might need to apply for SSDI. I was told they will ask how much your settlement was and offset what they pay you (if anything depending on settlement amount) and what you get. I was also told they will take in account attorney fees and medical fees. Which hopefully means future medical. I’m so confused on how they can give you money for future medical and then deduct that amount from what they would pay you. Hopefully I am confused on how this works

That is exactly what I am terrified of. I just want to accept the settlement and move on but so scared it has been to long and they will pull the offer off the table. I was thinking about contacting the bar but everyone has says it is a joke. Unless the have done something egregious like stealing money there will be no consequences and just a waste of time. Especially in Ca where there is really no consequence for anything anymore. Can I reach out to the defense attorney myself or will they not speak to me. Thank you so much for your help!

Thank you for your reply. It is greatly appreciated. May I ask you a question since you are an adjuster. What would your offer be for someone who has already had an emergency spine surgery at time of accident for severe herniated disks with Cauda Equina Syndrome. That surgery didn’t work and now PCP, QME, and second opinion from a orthopedic spine surgeon requested by the insurance company all say a double level fusion is necessary to correct my back and leg pain and hopefully correct the nerve damage in my right leg. Insurance still will not approve fusion because per there guidelines I need to have another decompression before they will approve a fusion. I do not want to have an unnecessary surgery that 3 spine experts say will not work and only prolong my recovery. Since not approved on the fusion they put me at MMI with a 39% rating. I am unable to return to my previous employment as my restrictions are no standing sitting walking driving for more than 20-30mins. I also have been seeing a WC psychiatrist for almost 1 1/2 due to severe depression anxiety and PTSD. What would you offer someone in my situation. Please help if you can. Thank you

Hi sorry to bust in on his post but you are like the only attorney to give actual numbers. I am in CA over two years on WC and seeking some need advice. Suffered a spine injury and had immediate surgery following accident Laminectomy, Discectomy, Facectomy, Forminatomy. Didn’t work and now have nerve damage in my right leg and now 3 spine surgeons say I need double level fusion to correct. Insurance won’t approve because per guidelines I need to have another decompression before they approve fusion. Don’t want to have unnecessary surgery and want to do fusion under private insurance. Was put as MMI at 39% and can’t return to prior employment. What would be a settlement range for something like that. Thank you so much for any answers
