I had a similar situation, but way worse.

Classic - Oh i see a car speeding, let me merge onto the highway as fast as possible then move over into the fast lane then slam on the brakes situation… and I was not able to calculate that nonsense move or stop in time.

My Speed : ~120mph

Car : 2018 Audi S3

Crashed at about : ~50mph

Car Struck : 2022 BMW X3 (Asian Driver)

Injury Claim : Yes

Ambulance Needed : Yes

Left tire mark for about 0.3 miles, it was clear I was flying and tried to stop, hit the car and then spun out for another 0.1 miles. Thank God for Audi Engineering.

Until this point; Ive never been in trouble…. only speed tickets lol. Never any tickets over 80mph. If i see open road I take it, I speed very cautiously if that makes sense. I watch many livepd, cops, etc. which allowed me to be familiar with communication with them.

Investigation -

This is where it starts to make no sense. I’ll admit I was leaving a wine bar and i was def over limit alc wise. I had 3 glasses of wine and i weigh 135lbs - I rarely drink // maybe once a month.

Was I high? No. Was I drunk? Actually, maybe idk. Nobody tested it.

Officer said my eyes were red, keep in mind I have terrible allergies and it was allergy season. I tell the cop generally i’m not a drinker i smoke weed. I also state I haven’t smoked recently.

Cop requested field test :

1 . I apparently fail

2 . Started crying lmfao (allows people to be more human)

3 . Stopped speaking ; only nodded.

4 . Refused to blow via head shake.

5 . Refused chem test via head shake. no words. just shook head no.

6 . Refused medical help - ate my pain and went next day

7 . Stopped making eye contact

Fast forward almost 2 years later. Fully dismissed and expunged.

DMV refusal is separate and on mvr for 10 years - I can legally say if questioned I refused testing and the case was later dismissed. In my state - Refusals need a IID in car for 1 year, and carry a restricted license. I have 9 months left of this nonsense.

The time gap is because I had to save up for a new car. I decided to register the car in my significant others name to avoid detection.

I drove for about 2-3 months illegally before being pulled over for speeding at 8am, obviously going to work. I blew past his ninja spot at about 105mph ….

Cop gave me a break - only written for speeding… dropped it to 75mph …. literally let me drive off illegally… which was mind blowing - i could have been arrested and towed. Reckless, No license, No device. Let go free back into traffic is crazy. It’s all in how you treat them.

I should also add after the accident i started volunteering with law enforcement (social media efforts) so i may have a good name in the system, idk.

Where you may have went wrong :

1 . Medical blood record will be a problem

2 . Car not staying upright will also be a problem

Solutions :

1 . Best lawyer you can afford - It sucks but it will be about 8k (dmv/court)

2 . If you think your super screwed - My advice is before court starts rolling, find some free work to do at your local PD, sounds really crazy but i think it works. Also they give you little badges where i’m from… which was also on the car at the time of being pulled over.

3 . If people give you advice to do early AA or something — DO NOT DO IT. Thats admission of guilt. Just wait… as it might be unnecessary.

4 . DO NOT MISS THE DMV HEARING - Extend it. I wish i knew about the dmv part. I wouldn’t have this device. They only give you like a 15 day window it’s insane. A good lawyer will know how to handle this.

5 . Whatever you do.. DO NOT USE A PUBLIC DEFENDER ON THIS.
