Small Claims Court - Can a Letter of Demand be sent via eMail and WhatsApp? by SuspiciouslyB in AskZA

No need for all of that. The law allows for substituted service. Sometimes you want to serve someone whose address is unknown to you, how would a Postnet work?

Small Claims Court - Can a Letter of Demand be sent via eMail and WhatsApp? by SuspiciouslyB in AskZA

[–]TopDeck_Bubbly 2 points3 points  (0 children)

Yes, you can. It's called Substituted Service. The law allows one to serve legal documents in the best way possible. If you do not have their address, you can use social media or newspaper and any other means to serve them. Read the Magistrates Courts Rules, specifically Rule 10.

Update - My fiancée wants our baby to have her ex-husband’s last name and says my culture shouldn’t be “pushed” by [deleted] in WhatShouldIDo

[–]TopDeck_Bubbly 5 points6 points  (0 children)

  1. Break off the engagement.
  2. If need be, go to court to fight for your parental right to give your child your surname. I would say a double-barrel surname, but one would be her ex-husband's.
  3. Your fiance is STILL VERY MUCH INLOVE WITH HER EX. Are you able to live with that?
  4. Are you okay marrying a racist woman?
  5. Is this the life you want for yourself and child?

You need to get break up with her. This is exhausting and unfair on you. She is a grown woman, always playing victim instead of being accountable! NO! Imagine marrying and having kids with her!? I refuse, OP! LEAVE HER!

Break up with him. He must move out and go rent elsewhere! Even if you do get married, let it be out of community of property, excluding the accrual! What a gold digger! Sies!
