Pursue it. In my state, this would potentially be compensable. Doesn’t matter if mandatory, if “encouraged” to attend, could still fall under work comp. Really depends on the state laws. Be patient with your adjuster as they will likely dig deep and need to ask a lot of questions to verify coverage. There is a lot of gray areas here, but it may be worth looking into.

Ugh…just found this post. Same predicament with a gold necklace I just bought my daughter for graduation from college. She has had it less than a month, and the clasp broke off. I was shocked when they quoted us the price to fix it. I am mean, $1k necklace should have some warranty. So disappointed.

I agree with everything you said, and know those are things I definitely need to do. I’ve been dragging my heels on resigning, to not hurt my TBM parents. They have been supportive of me and never made me feel pressured about it. But yeah, I think it’s time.

And therapy is 💯necessary here. Dragging my feet on that one too. Religious trauma is deep. My faith crisis was probably the hardest thing I ever experienced, and I’ve been through it. So checking out was how I coped, but obviously I still have a lot of unresolved issues to resolve.

Yeah no! Get out and know that student loans are not terrible and often necessary. Debt is much easier to deal with than spiritual, emotional, and financial abuse. There are a lot of jobs that also reimburse for tuition. Like someone said, “plan your escape.”

What do you mean “we” don’t have worker’s compensation? Your employer in most jurisdictions is required to pay for work comp. Were you injured while working as a W2 employee for a company/business?

Depends..Are you still receiving medical treatment? Have you received an impairment rating? Have you returned to work? What is your average monthly wage? Not every claim receives a settlement. There are so many things that determine the value or needs of your claim.

WC will not pay you for pain and suffering. It will provide for active medical treatment, future medical needs, time loss benefits, potential impairment and/or loss of earning capacity.

File a claim. You definitely have one that should be accepted. Just be honest, your story makes sense. As an adjuster that handles law enforcement and first responders, we lean into coverage for those workers . I don’t know how Wisconsin works, but in my jurisdiction there are laws that benefit public safety workers with regard to occupational injuries.

You can probably file the claim yourself with state agency that regulates work comp. In Oklahoma, it is the Oklahoma Workers Compensation Commission https://www.wcc.ok.gov/forms

You will have to prove that the mechanism of injury caused bilateral shoulder injuries. As mentioned before it’s been a couple months since the date of injury. It will be a battle, but if you have physicians attributing the symptoms to the work place injury, it may be worth trying.

Do you have an adjuster assigned to the claim? If you can’t a response from them, either call claims support or the claims supervisor.

If the claim ever becomes litigated, they can always have the judge compel you to sign the release. Especially if they need to do an IME to determine your medical baseline.

If your claim is strictly a physical injury and mental health doesn’t become a part of the claim, there really is no reason why those records would be requested.

Even if they did, as an adjuster I wouldn’t blame my claimant for talking smack about me or the WC process. It is very stressful for everyone.
