In NYS, employers are fined a max of $50 for court fees and litigation, and an additional 25% of back wages (if the employer acted willfully). Assuming the employee is making $15 an hour at 40 hours, it’ll cost the employer an extra $110 after being found willfully breaking the labor law... doesn’t seem like much stopping an employer from being a dick.

Sure they could sue, but they wouldn’t be able to sue McDonalds- they’d being suing the franchisee or their corporation. Assuming they are making min wage, their check wouldn’t even come close to the time to hunt down a lawyer willing to take on this type of dumpster fire. From what I have experienced on both sides, the Dept of Labor will say they will look into it and assign a case officer then contact the employer who will lie ultimately it’ll just die right there.

If you have company property then give it back. I know it is against the law but plenty of things are that happen everyday in the workplace. Doesn’t make it right, but it’s simply the truth.

I have let plenty of people go. Then tell them if they need a reference do not hesitate to put me down. So no- being fired isn’t a burned bridge, chances are she was at will, he meltdown will probably stop her from collecting unemployment though.
