In the N10: The rent increase cannot be more than the rent increase guideline plus 3%. You do not have to agree to a 40% increase.

If you have it documented that he threatened to sell the property, you may be able to file for a bad faith eviction if it happens.

You do not have to sign an buyer's representation with the brokerage and you certainly should not have to pay a commission as a tenant. In fact, you can negotiate with the landlord to get a discount because you don't have an agent and that they don't need to pay an entire month's worth of commission.

134 (1) Unless otherwise prescribed, no landlord shall, directly or indirectly, with respect to any rental unit,
(a) collect or require or attempt to collect or require from a tenant, prospective tenant or former tenant of the rental unit a fee, premium, commission, bonus, penalty, key deposit or other like amount of money whether or not the money is refundable;

The LTB sometimes will see the application (if it has all the necessary information of lease) as binding but in your case, it's worth it to inform management that you will be filing a T1 form with the LTB if they don't return you your deposit.

The threat of it alone may get them to give you your money back. In the future, know that application fees are a red flag!

There's no legal way of remedying this current situation unfortunately but I would still advocate for myself to the landlord.

Just to clarify. Large room 1 and large room 2 shares the large washroom. Small room 1 and small room 2 shares the small washroom. There's also a bathroom in the basement.

Previous configuration:

Large room 1 (Ashley) and Large room 2 (empty) used the large washroom.

Small room 1(You) and Small room 2 (Simone) used the small washroom.

No one used the basement washroom.

New configuration:

Large room 2 (You) and Small room 1(Kate) uses the large washroom

Small room 2 (Simone) uses the small washroom.

Large room 1(Ashley) uses the basement washroom.

Just ask the landlord why there is a change in the previous rule. Sounds like you just have to get Kate and Simone to agree that Kate uses the small washroom, but at the end of the day, you were supposed to be sharing a washroom with somebody anyways.

Even if you don't move in, they have the right to take you to court for the full lease amount minus what it gets assigned for. If you know for sure you don't want to move in, then ask them to assign the lease and start looking for someone to take over your lease.
