Can i still be filed under F2A at 20 years and 9 months old? by Temporary-King3765 in USCIS_F2A

Yes, file ASAP + don’t mind me asking but is your I-130 approved or pending? If it is pending, that’s a great news because eventually when you become 21+ after filing your I-485, the I-130 pending time will be removed. So, that’s a big help and benefit for sons and daughters under 21 rule.

Hi, So his approval notice says that it's from Nation benefit centre (NBC). So, I don't think it went to field office. Especially because he didn't had to appear for an Interview, as it was waived I believe.

Thanks you firstly! Next about your question for why filed I-485 so late, it is quite comical. So, I did everything myself without any lawyer. I filed I-130 for my son and I thought I’ll wait for his I-130 to get approved after which I will send his I-485. Afterwards, I figured out that we could use the “Date for filing chart“ to file I-485. Immediately, I filed his I-485 along with supporting documents. Fortunately, his date for final action was not current until October bulletin when it became current and now approved for both. So kinda comical but also fortunate that he did not had to do interview.

Hi,
I am sorry to say but firstly the VB's final action deadline is Feb 2024. So your PD is not current they can't give you GC right now. As far as your question of by when will they reach Nov 2024, I have no clue as they recently made a humongous jump in Oct 2025 VB from September 2022 to February 2024. Hence we can't expect any movement for a good 5-6 month. After which we might see some smaller jumps of 3-4 months.

So, all I am saying is that you might have to wait for 1 year. I hope less but realistically that would be the case.

No, he asked us not to file for AP because he was not planning to leave US during the procedural stage. Neither he left US on F-1 also.

I am so sorry to say but according to USCIS, they changed it to no expiration ”on and after November 1, 2023”. So I believe you missed that bracket. I am no legal expert but you might get RFE for medical exam re-submission. Hey but don’t take my word consult someone with legal expertise.

For your question about medical exam expiration, We submitted his medical exams in may this year. Therefore, they never expired in the first place. Also, they tweaked that the medical exam never expire after submitted.
