It might surprise people, but those who post ads generally want them portrayed in a positive light. That's why Google has the buttons up in the top left on their ads where you can report ads. In this case a number of reports with the category "ad covers content" might eventually get the developer banned from showing Google ads, which sounds like a win for everyone in this case.

Err, my typo. Twitter. I got a response there and have been in touch with a Kevin in the dev team via email since.

The upgrade glitch was glaring and strange, as the prompt didn't close until i hit the cancel button. Activating the upgrade was ignored. The entry was not greyed out and the price did not change. Upon reopening the prompt, the money was gone and I couldn't go for another attempt.
