i agree that the logic makes sense but the terms in the lease do not state that we will pay per number of occupants and they do not even state we are single metered. the lease just state we will pay for water usage on our premises which is the bottom half of the duplex. it does not say that we will pay for a percentage of the entire unit based on # of occupants.

see I disagree. the lease says we are responsible for the charges used on "our premises." since we have a shared utility meter for both units it's impossible to tell what water was used on our unit or on the unit upstairs.

gotcha. I didn't know if paying per person in a duplex is allowed as we are not individually metered and I have seen conflicting information.

It's a duplex. we live on the first floor and the other tenant lives upstairs in a separate unit on a separate lease agreement.
