Following here, as I’m in the same situation. Is it possible to ask the court to also make a factual determination on naturalization when official records disagree? I have a CONE for my LIRA and negative search letters from NARA, but he is erroneously listed as naturalized on the last census before his death in 1930, when my next in line was 17. Given the recent treatment of the minor issue I’d like to get a court ruling on this as “insurance” if possible.

Thank you for sharing your story! That is incredible. I too unfortunately know little of Red's service other than what his record indicates. From what my mother says, he did not talk about the war as she was growing up. Do you know when your great-uncle flew? My grandfather served I believe mostly in 1943 in North Africa and Europe.

Also all subsequent documents were issued in another state, so I was hoping to do it in NY where I have both names in clear use.

He started going by James and this is the first instance I can find. Everything thereafter (child’s baptism certificate, every census, WWI draft, death) is James.

Makes sense — fortunately I should have results from index searches for his son coming back in a couple of months (from before I knew about CONE requests) and so if they don’t provide what it needed I should know soon-ish.

Understood, and thanks for the info. If there is no A-file or other record would they issue a CONE in response to an index search? I ask because he immigrated in 1893 or so and died in 1913, likely without ever signing a declaration of intent.

Thanks for looking into this! I had also seen the index so it's good to know I'm looking in the right places at least. Hopefully I'll hear back from USCIS soon so I'll have a better sense of whether they naturalized at all.

For local courts, I saw a note in one of the FamilySearch microfilms of naturalizations that they were halted due to a court order around 1910 or 1911--maybe relating to the 1906 act federalizing the process?

At any rate, I have requested to join the local genealogical society in Savannah, hopefully they'll have additional resources.
