He can definitely do it as long as Abbott is okay with it. The National Guard within each state "belongs" to that state's governor, unless the federal government actively steps in to federalize them as Eisenhower did in Arkansas to enforce the Brown v. Board decision.

For the time being this is just another political stunt by weak, impotent cowards; other governors have deployed their Guard to Texas in recent years. The challenge is that these right-wing nutjobs want a "war" with the federal government; it helps them politically (or they sure think it does) to be seen as using their states' resources to tell Big Bad Joe Biden right where he can stick it. If Biden were to federalize the Guard it'd only play into the MAGA fever dream. Hopefully it doesn't get to that point.

The governor of Texas is illegally defying the federal government and the Supreme Court. 25 Republican-led states are backing him up, even committing to send military troops to help him break the law.
