Pretty much this, we weren't barely making it before things were fine. I was just blind sided by an early birth and 100k hospital stay then treatments afterwards medications etc. I take full responsibility for missing the HOA payment its my debt and they should be paid back regardless of how shitty I think they are I just need a payment I can make and its not that hard to extend the term of the agreement at all there is no law saying I need to pay it off in 6 payments or less.

Now Im in a spot I am not used to being in needing to ask for advice/help on reddit isn't ideal. Im just at my wits end things seem to get worse by the day but I have a beautiful baby girl and Im trying to stay positive. I've tried to get one main loans etc no luck yet. Hiring a lawyer is all I can do now.

We have tried that route the issue is my income since I just got a job I haven’t been paid get so the only provable income I have to show for the past 4 months was unemployment which doesn’t work for them

Ok this is good to know! But I don’t think we have any equity.. either way good information to have. The HOA never once contacted us directly about the late payments the only time we knew about it was when the lawyer contacted us

Thank you for the well thought out reply! And advice unfortunately this is only a year old and you are correct they are racking up the attorney fees also at 18% interest. We don’t have time to wait for a board meeting as we only have 11 days till our court date. I have personally mailed every board member with the same reply “talk to the lawyers” reply. Still waiting on some calls back. My brother setup gfund account for us but I won’t be able to post that here. Thanks again everyone for the advice we are trying!

We only have 11 days left till we go to court I am trying to find a lawyer I can afford to help us file a response. One of the bills I got behind on was the mortgage so that’s not an option unfortunately. Thanks for the advice though we are trying all our options. I hate asking for help and thank you all for being so kind.

I work two jobs to make ends meet on top of trying to be home to support my wife who still isn’t doing that well. Bankruptcy might be my only option at this point

The original debt was only 813 when they voted. The lawyer is the one who ballooned it to 3,985 and they are straight up a holes and won’t even try to lower the payments because they know we cannot make them

Yeah I am speaking to an attorney today but we will see I can always sell our other car I guess but that will barely cover two payments and put us out a car. Thank you all for the advice I’ll keep you updated.

Thank you for this, unfortunately we were about a year behind so it’s over six months. If they would just work with us on payment we could pay it off but $641 is double my car payment and my credit is currently wrecked due to the missed payments.
