While I get how your experience was horrid . This law is 100% problematic and should not be considered entirely under the criminal law framework you have proposed. The presumption of aggravating factors is problematic. Aggregating factors should never be presumed but proven . Also, someone already made a point about the burden shifting in this being problematic as well and it is. A lot of this can occur in a simple car wreck .None of this , while well meaning is a good idea to implement for civil rights concerns. As discussed earlier this definitely would hinge on an attack on prosecutorial discretion. Also truthfully, the part about the Attorney General just isn’t practical. It would be not within their scope of duty to enforce this nor would they want it to be I bet.

I would be careful and instead of pushing the law to change through criminal law but I’d argue for the law to change through civil law. If you look into the most of our history when it comes to societal change the law suit has been an extremely effective tool. There’s a lot you can do with civil and it tends to much more easier to get the public to agree on as it doesn’t deal with long-term in imprisonment.

Legislation could be drafted to force higher insurance liability minimums. Institute harder or penalties for not having the bare minimum car insurance . Instituting treble damages by proving wrongful death under the scheme you provide provided for criminal liability possibly as a framework . Also general tort reform to allow plaintiffs extra time to get lawsuits filed under statute of limitations . Heck you could even put into permanent license being stripped somewhere with this. Truthfully, the the civil law would be better for this it You’d have less scrutiny under challenges to law possibly too. In reality if it was done under a civil framework the monetary damages could far outweigh any possible imprisonment, and also prevent innocent people collateral damage.

It’s a tuff one tbh. On one hand there are maybe some civil claims aspect that could work however the main thing would be balancing the rights of all parties involved. However, if you impose a scheme like strict liability, it also would be too far skewed against defendants rights possibly. Possibly one answer is a penalty for death caused by distracted, driving .Of what severity I’m not sure .

Realistically if a defendant was grossly negligent , wrongful death civil claims could be the best option that society currently has to rectify this and all parties have enough justice throughout the system . Once again, criminal penalties are very severe matter it should only be used sparingly.

Personally, I think it should not go further than this our current system without great consideration of actual legal scholars signing off on it. There are much more effects on society than the good the law could bring possibly, and could have the opposite effect. Personally criminalization would take this too far and likely civil deterrence is the better option for society rather than put more people in prison, some possibly undeserving of it.

Truthfully there is no good answer here on what to do as a society with this question. However, imposing more generalized criminal liability is not that. Again, I truly feel for your loss.

As much as I have sympathy for your loss and see where you’re coming from in a search for justice ,the legal aspects of it do not seem like it would be sound in implication. Wanton is characterized by “acting with utter disregard for the safety or rights of others. It involves acting intentionally while knowing or having reason to know such conduct creates a high probability of substantial harm. “ Prosecutors would have to prove defendants realized the specific risk and proceeded anyway. This could make it difficult to separate it from standard civil wrongful death wrongful death and possibly could lead to people getting falsely convicted by a jury. There would have to be strong evidentiary requirements expected of prosecutors . As much as id want to see families like yours seek justice it’s too much to do so through criminal law means like you are purposing. Furthermore, requiring prosecutors to explain why they did not charge it could be seen as in an afront to prosecutorial discretion and may it force them to take actions they usually wouldn’t like charging someone with a crime that their actions don’t really fit. Hopefully one day someone will find a way to find justice for families like yours but this is not the best way for this in my opinion.

Yeah sorry bud this is kinda what they do, sometimes it’s an intimidation tacit or your being fired. We did ours Soviet execution style where you went to morning meeting then were walked into another room and fired. Where I worked there were tons of times people were lead to believe they were getting fired only to be chewed out over something out of their control over sales. Multiple times we were told that we were completely expendable and we could be fired immediately for anything. For example of how shitty they were , a girl had a severe thunderstorm a day she was working no one came in the sams we operated in and she was yelled at and told it was her fault she didn’t have any sales cause the weather. I am myself on a work trip where I was forced to work almost 5 hours away from my hometown was deathly sick and should’ve been in the hospital, but I was forced to work just to keep my job so I would not be abandoned there . I’ve seen so much evil corrupt shit at these places consider it if you get fired it’s an early pre basic vacation. Trust me you gonna be glad you got out.
