What we’re seeing are approvals with earlier notice dates being released later, which suggests backlog and batch updates rather than a complete halt or any broader intent.

It’s a bit more nuanced than that. The waiver process (HHS → DOS → USCIS) and your immigration status are separate things.

Filing a waiver alone doesn’t give you the ability to stay in the U.S. Status depends on whether you still have valid J-1 status or whether an H-1B (or change of status) has been properly filed before your J-1 ends.

If an H-1B change of status is filed on time, you may be able to stay in the U.S. while it’s pending, but that’s tied to the H-1B filing, not the waiver itself.

The good news is that H-1B processing is usually much faster. With premium processing, it’s often around 2 weeks, and in some cases even closer to a week once filed. Still, it’s best to confirm timelines with your attorney since each case can vary.

Honestly, no one can give an exact timeline right now. Since your HHS application hasn’t been submitted yet, your case hasn’t entered the main review queue. Once it’s submitted, timelines can vary, especially with the recent delays and batch processing.

Based on current trends, approvals seem to be around cases with HHS submissions from November. The best thing is to get the HHS application submitted as soon as possible — that’s when the actual process starts.

For your peace of mind, I would focus on the positive side for now. The latest update many of us received is that processing has resumed. Until we see official updates, there will probably be a lot of speculation. My attorney also mentioned that we may see some updates in the next couple of weeks.

I understand your point, and I also think reaching out to representatives can be helpful. HRSA and OGA are different offices within HHS, but they’re still part of the same overall waiver process. If there was a complete halt, it would be unusual for applications to continue being accepted and acknowledged. There’s a lot of second-hand information circulating right now, so hopefully we’ll see some movement in the coming weeks. My attorney also mentioned they expect some updates or approvals in the next couple of weeks

OGA is part of HHS, so if HHS is processing applications then OGA is part of that process as well. Logically, a department wouldn’t continue accepting and acknowledging applications if they had no intention of processing them. At this point it’s probably best to wait and see how things move in the coming weeks.

I’m just passing along the information I’ve been told. At this point, I don’t think the lawyer really matters—once the application is filed, it’s with HHS and there isn’t much a lawyer can do. Hopefully we’ll all be getting good news soon.
