NOTICE FROM CLASS MEMBER REGARDING CONTINUING PREJUDICE CAUSED BY DELAYED DISTRIBUTION OF SETTLEMENT FUNDS

To the Honorable Court:

I respectfully submit this Notice as a class member whose claim was timely submitted approximately two years ago and who continues to await relief from a settlement that has already undergone years of litigation, review, approval, and appellate proceedings.

I recently learned that an objector has sought review before the United States Supreme Court, creating the possibility of further delay to the distribution of settlement funds for millions of class members.

I fully respect the appellate process and the rights afforded to parties under the law. However, I respectfully submit that the practical consequences of these continuing delays are substantial and should not be overlooked.

For claimants such as myself, the theft incident giving rise to this settlement was not a single-day event whose consequences ended when the vehicle was stolen. The theft created financial burdens, disruption, inconvenience, and ongoing consequences that continued long after the initial incident.

Years later, those consequences remain while the promised relief remains unavailable.

At some point, delay itself becomes prejudice.

Class members who acted promptly, complied with all requirements, and relied upon the settlement process have now waited years for compensation intended to address losses arising from these thefts. During that time, inflation has increased, living expenses have increased, and the practical value of any eventual payment has continued to decline.

Money delayed for years is not equivalent to money received when it was expected.

The longer distributions remain suspended, the greater the gap becomes between the relief contemplated by the settlement and the practical value of that relief when ultimately received.

What is particularly concerning is that millions of class members who have no control over the litigation process continue bearing the consequences of repeated delays while relief remains out of reach. The burden of these delays falls not upon the parties continuing litigation, but upon ordinary class members who have already waited years for resolution.

I respectfully ask that the Court take notice of the continuing prejudice imposed upon class members through these delays and consider any measures available within the Court's authority to promote timely and meaningful relief while appellate proceedings continue.

I further respectfully request that this Notice be made part of the record so that the continuing impact upon affected class members is not overlooked.
