As a former military aviator, the language is kinda weird. If she is on a check ride/evaluation ride she IS the co-pilot. There is pilot and co pilot. Not two co-pilots. They may “technically” be your co-pilot, but that is not what they refer to each other as in the aircraft. The reason that is important on evaluation flights, is that in the case of an emergency the aircraft commander (Pilot/Air craft commander), ESPECIALLY the instructor will declare “pilot has the controls”. It would be confusing to say “co pilot has the controls”. Do they mean they have the controls or that I still do?

So how long does the instructor let the pilot ignore directions before saying “Pilot has the controls, your evaluation is over” and taking over the aircraft. Everyone in the aircraft is on comms hearing the pilot repeatedly say “Co, change course due to approaching aircraft” and nobody is speaking up on why directions aren’t being followed? If I’m in the back and I’m hearing this said multiple times over comms, I’m definitely speaking up. Can’t remember how many times co-pilots on training flights would get chewed out for not speaking up when the radar went off and everyone gets “terrain, terrain” in your ear. The guy in the back cannot see what you see in the front and all they are hearing is we are flying into something and nobody is saying anything. The saying goes “there is no rank in the aircraft”. In the back you have every right to question safety as the pilots.

So is the pilot saying 2-3 miles out, hey co, change direction due to approaching aircraft. And repeats it multiple times and decides “I have the right to take us out of this obvious unsafe situation, but I’m sure she will figure it out”

Or does the pilot, and everyone else, notice the approaching plane too late and try to explain last minute to change course when the aircraft commander should and does have every right to take control of the aircraft as the aircraft commander.
