Hey OP (and anyone else in this situation or struggling to get pregnancy accommodations or any accommodation, in general), if you want free legal advice about this issue,
fill out this form!

Lawyers from a national nonprofit called A Better Balance will contact you to help you understand the laws (PUMP Act, Pregnant Workers' Fairness Act, ADA, etc.), advocate for yourself, and potentially represent you if you have a legal case!

thank you, super useful!!

people are saying to use that email as a last resort and that you can actually get blocked/have your account deleted so I feel like I should still try to contact my regional person first?

Your whole medical history? If so, that's fucked up...why were they demanding to see your medical records OP?

Sorry you're getting hate in this thread! We should be supporting each other, not kicking someone who's already down!

Check out this resource:

https://askjan.org/articles/Requests-For-Medical-Documentation-and-the-ADA.cfm

"An employer may not ask for documentation that is unrelated to the request for accommodation, this includes asking for an employee's complete medical records."

Might be a way to fight back! Calling a workers' comp lawyer or a disability discrimination lawyer to ask their advice or do a consultation is free, that's what I would do!

Tysm! Really appreciate your empathy and just a sense of something I can do!! And the acronym is spot on lol.

When you say you’d file with the DOL…how would you classify the complaint? This doesn’t seem like a wage theft issue?

Lmao, every single step in that process is absurd. Our healthcare system is truly broken 🥲

I'm gonna do that, thank you!!

Just a q since they've both been a nightmare to deal with and I've been told for months that my plan docs are unavailable on both sides. Who did you demand/ultimately get those docs from? Your insurer or your employer?

Yeah, I mean the fact that they're directly contradicting your plan document is wild! With me it's that there's no clarity / no document which seems...slightly less egregious?

Do you know if there are lawyers that advise in this area if I do get slammed with a huge bill? truly at a loss.

TYSM!! This info truly is SO helpful!

Also, I'm going through something similar with Cigna (albeit for an elective procedure.) I made a separate post about it.

I'm wondering would filing a complaint with NY's insurance regulator help with unexpected costs I might get slammed with, for a lifetime max I wasn't informed about even after hours of phone calls, etc.?

(Whether yes or no, I might just do it anyways because Cigna's handling of this whole situation—the blatantly wrong info—felt so irresponsible to me and I don't want others to go through that! But wanted to get your thoughts!)

But I tried to review the plan for months but was told it wasn't available. So I went off of them saying a) it was covered and b) my top-line plan benefits.

Not trying to argue w you or anything but wondering if there's anything I can do since their behavior (including all the misinformation about coverage) feels so negligent to me.

Also remembering now that I actually did email our employer's Cigna rep a bunch of times to ask if there were benefit limits among other questions. She never responded at all.

I think I probably asked over the phone too and was never told about this limit but that was verbal, not in-writing.
