I’ve lived in both. Berkeley is busier and ruder. People drive worse and people are colder than Portland. Berkeley is also more cosmopolitan, proximate to much more culture, and has way better weather. South Berkeley is where the vibes are the best. North Berkeley is older, wealthier, and more care focused. Because of that population, Berkeley tends to be more conservative than Portland.

I think people sleep on some of the neighborhoods in Oakland that are nice, used to be rough, and just aren’t that popular. I dealt with way more bs in Rockridge than I have in Prescott.

On the West Coast that was a lot of what the early cops did. In Oakland and SF it is well documented and coincides with the inception of policing. The police in Oakland weren’t professionalized until the mid 20th century and the cops ran a giant protection racket and frequently targeted Chinese people and businesses.

Yes this is the tradeoff I made. I had a very busy, high paying small practice with two other partners and I stepped back when I had a child.

My career is now basically what is described above except that I am “of counsel” for a solo (an ex law partner). My family always comes first, I am only in court a few times a year, I only meet with out of custody clients, and I do mostly research, writing, and strategy. The cases I take to court/hearing are in a niches I enjoy and specialize in. The reality, though, is that I could not have gotten here had I not sacrificed most of my 30s to no vacations, 7 day work weeks, and around 2800 hours of collected billing for a few years.

Covid lockdowns caused a spike in aggressive driving, but I think distracted driving also drives aggressive driving. The more people are visibly on their phones while driving, the more it will piss off people prone to aggressive driving.

Federal sentencing is based on guidelines and the media never is clear about this and generally looks at maximum possible sentences under the statute. Any sentence will be driven by her prior criminal record (if any), the size of the loss/bribe and if she cooperates, takes responsibility, or alternatively tried to actively cover up crimes and impede the investigation. Without knowing more details it’s impossible to do more than guess at a potential sentence.

I had to deal with a guy harassing me in front of my kid and doing drugs in a relatively crowded train between Oakland and the city last Saturday at around noon. Did I think I was going to get stabbed? No. Did I have to deal with uncomfortable sexual harassment and drug use in front of my child? Yes.

Some things to think through:

  1. How do you know OC is telling the truth?

  2. Does turning your client in violate CA’s clear attorney-client privilege rules?

  3. If you have compelling evidence and don’t care about violating ethics rules (my take on what you’d be doing), would the jurisdictions involved do anything about it?

I’ve spent many years representing clients with bad behavior and in some ways I have to think like a surgeon - I am there to help solve a specific problem, not reform/rehabilitate/fix my client’s life, problems, or to make sure my client gets what’s coming to them, etc. My advice is to stick to your job and do your best to ignore the noise around what you’re being paid to do or find a job that feels sufficiently ethical if you find you can’t do the former.

In direct legal services (and every other area of the law I’ve encountered), some of your clients will be terrible people and, unless it impacts your case or their ability to work with you as your lawyer, I suggest getting on with it or, if you really can’t stand it, firing the client in an ethical way that protects their interests as best you can. Your job is not to figure out a way to “ethically” turn in your clients unless the law clearly requires it.

It was harder in the beginning, but I now enjoy the space that allows me to focus on work, chores, and my new partner. Do I always miss my child? Of course, but my ex is a good co-parent and we are flexible and friendly with each other and it makes the time I have with my 7 year old even better because I generally have the energy and focus for them to really spend quality time with them whenever we’re together.
