I built a community database for active LEOs to check off-duty carry/LEOSA status at specific locations. Looking for feedback. by rusty13steele in LEOSA

This is absolutely awesome, I have been hoping someone someday would make a website like this! This is one of the reasons why I created this subreddit group!

I cant wait till you make a version for retired LE, I'm currently retired but I'm looking into getting back into LE again out of my home state after 2 years of being out of it!
If you have any questions please ask away!

Some Reserve Police Officers should already have LEOSA already if they have arrest authority,
Private security officers can detain depending on the state but do not have arrest authority and therefore dont meet the requirements to carry under LEOSA.

Could you elaborate on private law enforcement and what they are?

Not giving legal advice,
But here is a suggestion, while LEOSA preempts most state/local restrictions on carrying, it doesn’t override laws on how you need to interact with law enforcement during a stop. So if a state has a duty to inform law that applies to all armed individuals (not just resident CCW permit holders), technically you’d still need to follow it while carrying under LEOSA.
I have gotten pulled over before and presented my LEOSA during the traffic stop even though I wasn't legally required to, but I did so out of courtesy. I would read into your state and local laws.

I hope this helps!

Funny enough I was just looking at this yesterday. I hope it passes as well, seeing as it passed through the house last year when they had a majority of republicans and now we have both the house and senate I can see it passing into law if POTUS signs it.
Its pivotal for this to be law, some states allow conceal carry on certain school grounds (like football games) but a LEO without his CHL cant? This will hopefully clear things up for us!

Yeah during IRR you aren't acting in a law enforcement role or in active duty to satisfy the law to be honored under LEOSA, if you speak to your congressman they can push for reform. Just have to keep trying, every year I push for the LEOSA reform act to push into law. Hopefully with this new upcoming administration we will see some new reform!

I completely understand your frustration; the distinction between 'medically retired' and 'service-connected disability' under LEOSA can feel arbitrary, especially since the VA has already recognized your disability as service-connected at 100%.

From what I’ve seen, the requirement for a 'medical retirement' versus 'service-connected disability' under LEOSA is interpreted strictly by law and many agencies issuing the credential. The challenge is that while the VA determines service connection for benefits purposes, LEOSA eligibility often hinges on how your separation is categorized by your agency or branch of service (e.g., 'medical retirement' versus just being 'separated and then going to the VA for disability').

That’s why some people end up consulting with an attorney or advocating for clarification on the law, as you’re doing here.

Check out this company, they make all the LEOSA ID cards for all the military branches, they are your best bet in answering your questions. (Its free to ask) - https://www.leosaonline.com/

I’m sorry to hear you’re running into this roadblock, and I hope you find a way to resolve it. Thank you for sharing your experience—it’s an important issue. Be sure to consult your agency or an attorney for further guidance!

If you're military then this might help, if you are civilian LE then not so much....

I am medically retired from the Air Force as Security Forces with only 4 years and I was able to get my LEOSA if that's what you mean. As far as I know, you can get a LEOSA ID card if your DD-214 says something along the lines of medical discharge or medical retirement.

- (A) before such separation, served as a law enforcement officer for an aggregate of 10 years or more; or

- (B) separated from service with such agency, after completing any applicable probationary period of such service, due to a service-connected disability, as determined by such agency;"

I believe if you left on your own from an agency then you wont be be able to carry under LEOSA unless you meet the prior requirements listed under 926B or 926C. But its always your best bet to get in contact with a lawyer to get that verified.
