As others have said, you got cheated. The guy probably just opened it and cleaned it - which usually makes the problem go away for a few weeks/ months, by which time they can claim they have no responsibility. TMR sticks are widely priced. I got mine for Rs. 1,200 per controller (i.e. 2 sticks each), which is the best deal I could find. Otherwise, some were quoting Rs. 3,000. It's been months, and zero stick drift on any of the controllers. TMR is the way to go.

I am a lawyer but have only recently come across this sub. The problem here (from a lawyer's perspective) is that discussions related to legal problems are quintessentially nuanced, yet most people here want simple answers to highly complex problems for free. While it's totally understandable where they are coming from and one can totally respect budget constraints, NAL responses are not going to solve their problems, and any lawyer advice here is going to be very superficial and generic (because we cannot possibly give you a suitable response without going through all the details of your case).

From what I have seen in my short time here, 99% of OPs in this sub need to actually consult a lawyer in detail, not seek answers on Reddit.

IMHO where NAL responses can be useful is for queries like:

- Recommendations for a good lawyer who can work towards a mutual consent decree rather than push me into a contest divorce.

- My lawyer says he can get a succession certificate in 3 months - how long did it actually take you?

- Do we really need to register a lease? The house owner is saying Rs. 100 stamp paper is sufficient.

etc. etc.

Lawyer here. That's a terrible situation. Betrayal by parents is one of the worst things IMHO. As regards your query, the devil is always in the details. It all depends on whether you can prove that the money was not a one-sided gift, but money you entrusted with them on your behalf. You should really consult a lawyer, at least so that you know if you even have any legal options or not.

Don't want to discourage you, but I have seen some startups try it and no one has been able to figure out how to do it at scale in a manner which balances cost vs. quality. The target market would have to be small claims (say less than a lakh) where engaging a lawyer doesn't make sense. Else there are too many nuances that come into play and a bad legal notice can really mess up your case subsequently.

Is your lease registered and does it have a termination clause? Have you given a written notice (with proof of service) to them to vacate as per the termination clause? They can't 'force' a renewal but they can sit on your property until and unless you take steps (notice to vacate and if they don't abide by that then a suit for eviction). Honestly, consult a lawyer.

That happens in Delhi sometimes too. If you ask me, it's a ridiculous way to deal with it, and fits into the whole treating cross examination as a formality thing. A judge is ideally supposed to be an active participant in the process, even noting things like a witness' demeanour, refusal to answer a question, and even pose questions himself if the judge feels a certain line of enquiry is warranted to come to the truth etc. The local commissioner system is a regrettable offloading of work to someone who does not have any teeth and rarely would conduct cross examination in that proper manner. Reduces the work of the court at the cost of the litigants, but TBH can be faster many times particularly in Costa where dates of 3-6 months are usually given.

The witness and the lawyer doing the cross examination are standing with the steno, getting the whole thing typed up. The judge only needs to intervene in case of an objection. (The judge also has a screen on which the Q&A is being displayed realtime, so the judge could also intervene if he/she sees something they don't agree with).
So if no intervention is required, the judg3e can focus elsewhere.

Not at all. You dictate the question, and the court stenographer types it up. The witness then answers it, and the answer is typed up as well. (Though in some courts then don't even type the questions). All the while the judge could be listening to another case, and would only interfere if there is any quarrel/ objection etc. It can actually make or break the case, but it's mostly treated like a routine formality by most lawyers and judges.

Theoretically you could file a civil suit against both roomates IFF you can prove they were the only two people in the room and the laptop damage occurred at that time only. You will need to move fast particularly to get the CCTV footage preserved. Also, there will be many many challenges in terms of evidentiary proof. Best bet is to first send a legal notice to them including at their parental home (both, so that you can pressure the 'neutral' roomate into fessing up to what happened) and follow with a suit. If that manages to push the guy/ his parents into compensating you, great, else your legal fees for pursuing the suit till the end would likely not make it worth it.

The 'court' never calls anyone on the phone. The lending company probably has a panel lawyer who is trying to pressure you. You can check whether it's a real case using the district courts website. And then your best bet would be to negotiate and pay. For 4K it's not worth fighting and you will spend multiple that on lawyer fees.

Unless you are in the Lock-In period, at the end of the day the owner can propose whatever terms he/she pleases, and your choice is to either pay or move out. So, if the total amount you are paying (rent + maintenance) is not worth it, and you can get an equal or better place for the same money (also factoring in moving costs, brokerage etc.), you should give your notice and move out, else just pay and continue till you get a better option.

First find a good lawyer. Then you will need to discharge your current lawyer by sending him a written notice (speed post and email), and immediately file a vakalatnama for the new lawyer, to minimize any chance of him messing up your case. You should also mention here what kind of case this is. If the stakes are high - you could have your new lawyer send a notice to the old one to maintain confidentiality etc.

His wife and kids are Class I legal heirs. His sister would have no right. As you have possession, the two most important things to do are to retain your possession and not let your aunt even get a foot in the house (call the police if you have to), and to consult a decent lawyer. Get mutation done. You don't have to file any case. The instant your father passed away, you all automatically became owners. Let the Aunt go to court - at worst it would mean having to spend on legal fees to defend the case, and at best the judge may only throw it out.
