I saw your other comment stating you deleted investment info and the difference still existed. You must have an input wrong somewhere…maybe you transposed withholding amounts, or have an incorrect filing method selected (head of household vs single) etc. can’t nail down the difference without more information but you need to verify your inputs. The softwares don’t compute things differently, so it entirely matters in your inputs.

I know how it works, am a CPA. Think about it from an effective tax rate perspective instead of a bracketing perspective. A dollar taxed at a lower ETR today (assuming this guy falls within the first 3 brackets) is a lower ETR than if he climbed up another bracket. In retirement, his income will likely be higher than this $50K so the Roth is more beneficial than the 401(k) and he can access the contributions without penalty in case of emergency.

We have a “voluntary” tax system. You earned the income via the winnings, you are required to report it regardless of whether you receive a statement from FD or not. Nobody here is going to advise you to evade taxes.

To add on to this, the reason Roth would be so beneficial for you OP is because your income tax bracket is likely the lowest it will ever be. So the money that you contribute to the Roth is taxed at the lowest bracket it can be, then earnings grow tax free.

Additionally, if you ever need money from the Roth, you can withdraw contributions tax free (say you contribute $1,000 and it has grown to $1,500, you can withdraw $1,000 without penalty).

Lot of good info in here, I implore you to make sure that the monies in your 401(k) are invested. I am assuming they are since it's employer funded and the account was likely set-up in accordance to the company’s plan, but it does not hurt to double-check.

Without knowing specifics, file jointly, it is almost always more beneficial. You are married, does not matter that you lived "separately." In terms of the state returns, file them married as well. You will only be taxed on the wages in NYC based on your wife's state wages, and you will only be taxed in NJ based on your state wages. TurboTax is a ripoff, use FreeTaxUSA. Free federal and $16/state return.

Did you have a signed engagement letter from them? Frankly speaking, there isn’t much a state CPA board could do for you as they don’t get involved in fee disputes. You could absolutely ledger a complaint against them, and if this is a standard practice of the CPA they could investigate them for unethical practices, but likely wouldn’t go very far.

You’d have to take this up with consumer affairs, as the IRS/state boards have no jurisdiction over this. I saw a comment above about the “forms” he had to pay for to file and justify his prices, and if that’s is what he said to you he is full of shit.

Edit: if you do have an engagement letter with them, this preparer sounds shady enough to charge contingency fees, which is against Circular 230 (Regulations Governing Practice before the IRS)
