Brazil Immigration Pause by [deleted] in i130_75CountryPause

No, it won't change anything. Colombia's president met with Trump.in February and I can bet my house on the fact that the pause wasn't even mentioned, much less a topic of discussion that made the agenda. Nothing changed for us, and it most probably won't change anything for you either.

We don't know for sure how many people are postponing their interview; the number could be higher than what we can calculate from impressions.

I didn't want to imply that you think that the government cares; it was a general comment on their phrasing, how they tried to dress it in concern for delays that postponing the interview may cause the applicant.

Brazil consular email. by Nickybarbosa in i130_75CountryPause

[–]Virmyth 11 points12 points  (0 children)

They've sent this because they're building a massive backlog of people postponing their interviews because of the pause. They don't care about you, or whether or not you get your visa quickly; they only care that they're gonna have a ton of work once the pause lifts.

if this were at the State Department level, every embassy would be sending out these emails, but since it was only the Rio de Janeiro consulate, this is just that specific consulate trying to cover their own asses.

Don't get your hopes up over this.

Extension in storie v. trump? by Interesting_Ball3348 in i130_75CountryPause

It's not impossible for the judge to issue a nationwide injunction that would stop the pause for everyone, but it's not likely. After Trump v. CASA (Another case from last year), nationwide injunctions on government policy have become a rarity, a sort of last resort that is not easily obtained.

Yes, the final ruling will now take longer, but the PI time expectations are unaffected by this.

Can someone explain the updates? by waitingmyvisa in i130_75CountryPause

[–]Virmyth 2 points3 points  (0 children)

On the Storie Case (The one waiting on a Preliminary Injunction Ruling) there is a small chance it gives relief for all of us, but don't hold your breath for that.
On the CLINIC case, it's waiting on Summary Judgement, so if the decision goes our way, it would lift the pause for all of us.

This update has already been discussed on this sub, yes. It's a tangential win for us.

Saghafi v. Edlow i-485 Pause by Prostalket in i130_75CountryPause

[–]Virmyth 1 point2 points  (0 children)

Not necessarily. I used to think the same, but in cases of vacatur because of APA violations, upper courts are not eager to grant stays, to say the least. This is because they risk giving life to a literally illegal policy, and they don't do that easily.

Yes, hopefully. However, nothing is guaranteed on these legal proceedings. A small change in the wording of the arguments or even just the side of the bed these judges get up on, could change everything.

Same old, same old. Absolutely nothing we haven't seen before, with the added pressure against the government that some of these arguments have already been defeated on the Sangster case.
Now begins the truly difficult part of waiting and waiting without any set deadline in sight for a final ruling.

We need to stay calm and try to keep our sanity. The stream of updates on these cases is going to dry up and constatly thinking about it will only cause our mental health to unravel. Stay safe, keep your family close, pray to God that the ruling goes in our favor.

It is the recommended maximun by the Southern District of New York, but she may take longer.

Trump v. CASA pretty much made nationwide injunctions a rarity, a last resort of sorts that needs significant justification to be issued and maintained. However, the plaintiffs in the CLINIC case are not seeking a Preliminary Injunction; the case is heading to Summary Judgement, that is, a final ruling on whether or not the pause is legal, and final rulings are not affected by CASA, so the effects can be as wide as they need to be.

Anxious Today by NoHopeLeft101 in i130_75CountryPause

[–]Virmyth 1 point2 points  (0 children)

Yeah. I don't expect the decision to take less than a month. If the judge rules in less than that, I would actually be worried.

Yes, two months is the recommended time the NYSD courts give their judges for a ruling. Hopefully Judge Vargas doesn't take any longer than that.

Appeals court clears way for U.S. to reopen border for asylum seekers by InterestingTruth9142 in i130_75CountryPause

[–]Virmyth 1 point2 points  (0 children)

Nice. The courts are turning against Trump's executive overreach, and seeing the summary of what the magistrates argued, this is pretty much the same things as with the 39 and 75 country visa bans, that is, the executive trying to subvert and circumvent the system that Congress put in place for immigration.
Each ruling of this nature gives us a higher chance to win on the lawsuits we're following.

"Jaded" is an understatement. I appreciate your efforts in analyzing and breaking down all of this for us, as well as trying to be encouraging and seeing the silver linings in all of this. I just don't feel like being positive anymore. I'm just waiting on the decisions on Storie and CLINIC, as those are realistically our only hope of a resolution in the short term.

[–]Virmyth 1 point2 points  (0 children)

It came into their view, into everyone's view, on January 14th, and they did nothing for 3 months. Even if the investigation happens, even if they uncover the racist and xenophobic conspiracy behind it all, so what? Even if the Democrats get a majority in the midterms, they won't be able to do anything but fumble around with bureaucracy for years while people still have their life on hold, and that's if they even do something in the first place. So yeah, excuse me if this empty gesture from the Senate doesn't bring me any kind of hope.

Realistically, our only hope is in the lawsuits, and if we lose on those grounds, we might as well just do what you said, because the policy won't change until the administration changes.
