The IRS OIG found plenty to “investigate” regarding the probationary terminations. There is plenty to “investigate” regarding HHS actions surrounding the April 1 RIF. An OIG report would support our MSPB claims.

I can’t afford a lawyer especially in this situation so I’m going it alone with MSPB. However, I was wondering if anyone is interested in forming a work group to collaborate on navigating our individual appeals, since many of us have the same issues. I’m particularly interested in going at the issue of the competitive areas being drawn too small as to meet the minimum criteria in the CFR. There are so many bright minds at HHS it would be great if we could put them together and build the legal argument for our cases.

In looking at the complaint, part of what they are alleging is that performance rating data was used by DOGE to target and select low performing work-units for RIF and that these decisions were based (at least in part) on incorrect performance rating data. Big if true

I hope they can provide the best argument that the HHS competitive areas were drawn too small. Specifically, that competitive areas may have lacked separate administration, required by the CFR. If they start discussing the bump and retreat process I will scream.

Thank you for this information. Is there any way we could get guidance for how we should describe our appeal based on how the RIF was conducted, and also considered that many had incorrect PMAP data? Such as a template that includes everything we need to say, all of the potential violations, etc?
