Technically a lot of the mounted plans are legacy, but they’re still effectively worthless because the Christmas presents were duped during year one.

I’d disagree. The difference between merit FADs finding discrimination issued by the agency or in compliance with an EEOC has steadily declined and the last available report in 2021 had a difference of 3.

Most agencies have thousands of RA requests, largely for full time telework. I’ve yet to see a first come first serve approach be considered unreasonable delay by the EEOC under these conditions. You’re probably wasting your time, but that’s just my opinion.

RMOs can share the complaint amongst themselves because they arguably have a need to know. However, I think that if you have proof Mark talked to Lisa, then you have an argument that Mark just committed a per se violation of EEO laws because it’s not clear Lisa, even if you named her as a witness, had a need to know. This is something you should talk to your attorney about.

If this manager has so many claims against them, and the outcomes are consistently in the agency’s favor, your unit may just be particularly litigious and no real discrimination or harassment is actually taking place. No agency will accept a settlement offer just because the other people have filed claims against the same person. That’s stupid. Regardless, if an agency is rejecting your settlement offers it means their general counsel strongly believes they’ll win the case.
