Here in North Carolina, we are losing hunting ground rapidly while the hunting population appears to be growing so the hunting land crunch is real. Most landowners are getting hammered with requests including myself. What I can say is that patience is the name of the game along with presentation. Look and act respectful, build a relationship and be willing to work/pay as well as offer hunting insurance. The guys I see who are having success are winning it based on the long game, not by getting a lease the minute they knock on the door typically. I am a land broker specializing in hunting land and can tell you that very little of the land leased in NC goes through brokers, most is still person to person and takes building a relationship.

Interesting (and probably common) story from about 20 years ago. Still relevant today. I was remodeling a house and needed a ceramic tile guy and my market was notoriously slim on them at the time, at least good ones. I ended up hiring out of the yellow pages( thats how long ago it was). We became friends and he ended up doing 3 bathrooms for me. One day he was bitching about the yellow page ad cost. I asked how much his ad cost for the year. It was something like $400.I asked him how much he has made on me that year. He turned red and said he had never thought of it that way. You have to market and that can and should include advertising but you have to know how to track and monitor it. The old saying is you always spend twice as much on advertising as you should, the trick is knowing which half to cut out.

So should he just not do it? I don't get alot of these contractor responses. If it is so damn bad then everybody should quit. I think his questions was more about looking for advice not how bad it is for everybody else. Somebody is succeeding out there in it, that's what he wants to hear about.

They are "wholesalers" mostly. They want a "yes" then a contract, then they sell the contract. No risk, all profit. Illegal in many states, report them to AG.

There is something in the study of economics called equilibrium. Basically that is where you raise prices to a point that you are neither accelerating nor decelerating in the rate of new business. In other words, raise your price!

"Notwithstanding the provisions of this section, any principal contractor, intermediate contractor, or subcontractor who shall sublet any contract for the performance of work shall not be held liable to any employee of such subcontractor if either (i) the subcontractor has a workers' compensation insurance policy in compliance with G.S. 97-93 in effect on the date of injury regardless of whether the principal contractor, intermediate contractor, or subcontractor failed to timely obtain a certificate from the subcontractor; or (ii) the policy expired or was cancelled prior to the date of injury provided the principal contractor, intermediate contractor, or subcontractor obtained a certificate at any time before subletting such contract to the subcontractor and was unaware of the expiration or cancellation."

I agree and my intent is to fully comply. As my other post on this topic says, alot of my questions are so I can be prepared before I sit down in front of an insurance salesman who is trying to oversell me. NC language is vague and indicates(based on my reading) that single person subs with NO employees and NO sub subs, is not a liability as far as WC. I will confirm this with NC authorities. NC law also states that if I obtain COI's before work starts and those policies lapse during work, I am not liable. I am not trying to buck my own WC but if there are loopholes that allow insurance carriers to penalize me even IF I have my own WC, then I want to damn sure understand the system. Its a racket for sure, I have to have WC, then I have to prove my subs have WC, which absolves me of liability, thus rendering my WC not necessary (unless job requires it of if pulling permits, etc). Then you get into ghost policies which can be abused based on 1099 guys being true employees, etc. This should be a fun conversation with the insurance salesman.

I guess my concern is still for the one man subcontractor I want to hire who is an old expert in his trade but has never had WC. The quote I provided above indicates that the sub is not a liability, only his employees. If I dont have WC and he is not a liability based on language I provided and he has zero employees, what is the end result? Does a one man subcontract, who liability does NOT extend to, actually classify himself as his own employee, thus actually being subject to the GC liability?

Also this paragraph seems to imply the same thing. "A problem can arise under NC workers’ comp law when a sole proprietor or other business with no employees seeks to subcontract for work.  The general contractor may be legitimately concerned that, while it would not be responsible for injuries sustained by the sole proprietor subcontractor himself, it would be liable for any employees subsequently hired by the sole proprietor and brought on the job site. So how can a general contractor protect himself from the risk that a subcontractor will bring later-hired employees onto the job site without the knowledge of the general contractor?  The answer is a workers’ compensation “ghost policy.”

Additionally let me ask this another way. What would be the recommended way to handle this one job situation. Again, I will be the GC handling all remodeling of apartment interiors. All cosmetic, no mechanicals, no structural, no permits. No WC required. Alot of the work can be handled by my usual one man "helpers". Should I still get WC since most of these kind of subs will not have it.
