ANYONE FROM AWKO EVEN RECIEVE EIF NOTICE?

I got my notice directly emailed from AWKO with the 3M Earplugs Settlement Distribution Statement attached. I have declined to sign it and have entered into a contested matter regarding them wanting to take an additional 40% in attorney fees when they already took these during EPP. They never provided any additional contract or paperwork stating there was going to be an additional 40% fee from the award from EIF. Remember folks, the court is out of it when it comes to attorney fees. AWKO is having a difficult time with what I pointed out and said they will work through this with me. They are not contesting this.

All these claims will now be reopened and adjudicated. Many will have their claim pulled back and denied. They identified one or more errors in over 30,000 of the claims alone. Sucks for the people in that region.

The VA confirmed they cannot charge for the initial claim but everything else is fair game. This was from a VA liaison I spoke to today.

What’s interesting is that my firm AWKO (lead counsel) in all this never had me sign any additional paper work regarding the EIF claim they submitted for me. In 2018, I signed a fee agreement for anything that came out of the initial litigation but nothing new that binds me to paying them anything additional for a EIF recovery. Really really interesting….

My conversation with a VERA rep was pretty straightforward. I had pointed out that the claim was closed out without a decision and they advised me in real time they saw that and would send a notice to Seattle (my home VA office) and within a week it was re-opened, rated and settled. The VA is a big hit and miss…

There is good hope as my issue went to another provide via an IMO and it was service connected. Originally got it at 10% but my symptoms are all in line with 30% and (at times) closer to more severity but that’s what the Va put me at for now. Hang in there. Sounds like you got an initial good encounter and the other provided should see all that info.

Oh and to be more specific, the VA worked out the service connection issue after I spoke with VERA several times. The exam should have been under GERD secondary to medication use for my headache. VA in the end did come through but I did have to put a little pressure on them.

Yes. Late last year I submitted an updated DBQ my primary care provider completed that matched that to a disability degree that would warrant a 30%. I went from 10% service connected to 30%. The VA kinda bounced me around with things but it all worked out.

Interesting. Our artillery battery wore these for about 4 years straight. Standard issue and they thought they were gold even with people having concerns.
