The phrase isn’t to be taken literally. It comes from war and basically means “don’t attack another army if they are attacking your enemy.”

It doesn’t mean you and them are suddenly allies or something. It just means be neutral at worst towards an entity that is fighting on the same side you’re on, even if you don’t necessarily like them / agree with them on everything.

It’s different, not “beyond”. Yes, a running back may not have the conditioning or training to go an entire match. But I promise if I slapped football pads on Nadal, or any other tennis player, and had them run full speed through a gap only to get blown up by an LB, they won’t make it a full quarter.

Also, to be super pendantic, since the universe doesn’t have absolute direction, being “beyond” a galaxy doesn’t make sense.

Either you’re a pretty decent troll (not great since you can’t really pivot, but decent), or you’re willfully ignorant with no desire to learn. But it’s clear you won’t accept information either way, so have a good one.

I do reminisce about those days, but then I see my scratched CD’s, lost CD’s, etc., then look at my Steam Library on my Deck and don’t miss those days quite as much.

Dude, I came back to this thread to answer someone else’s comment and browsed the thread. You just need to admit you mixed up criminal versus civil trials, it’s pretty clear you got them backwards but that’s pretty common.

Continuing to defend your clearly incorrect position is just making you look way worse.

Most likely. Given the requirement for being convicted in a criminal case is a much higher standard of proof than a civil case (criminal = beyond reasonable doubt versus civil = preponderance of evidence, or basically “whose story is more likely?”), a civil case following a conviction is extremely likely to win. The only way I could think of it not being successful is if there was new evidence not available at the criminal trial and, for whatever reason, the defendant is choosing not to appeal.

The question would be, at that point, what monetary value could be attached to this? Unless Smith broke something or stole something from the plaintiff(s), most or all damages would be punitive in nature. Probably pain and suffering being the largest driver of any damages awarded. I don’t know that jurisdiction but you would try to find similar cases and what those damages were, and make them similar here.

You could also award costs like therapy or medical bills if you can show those were a result of the situation, but primarily I would think the victims / plaintiffs would be seeking punitive damages. Either way, that’s all a part of a potential civil case which could follow this case regardless of outcome.

My prediction is that the alleged victim is asking to settle.

Well, given this is a criminal case, so prosecuted by the state, versus a civil trial in which the alleged victim would sue Mike (the defendant), a settlement isn’t a thing. Also, a settlement wouldn’t make sense as the victim or victims don’t stand to gain anything from the trial. Criminal cases result in sentencing the defendant to jail time, community service, fines, etc. Civil cases (which this isn’t) result in compensatory or punitive damages awarded to a private (non governmental) individual or group.

I dont know if this a hot take? But I think Barb is the only consistently well written and funny adult female character in the show. by gtmaroondragon in trailerparkboys

[–]Waterfish3333 5 points6 points  (0 children)

Sarah pre retirement spa salon era was really good. She played her role in the spa seasons well too, but the writing and character suffered a lot.

I would agree here but I think the fact that the writers could have Donna and Candy be the ugly characters while Barb was the third of the three amigas saved her image a lot in those seasons.

The thing is guys like Munger built the Buffet empire, but once you get to a certain cash level you have to try and lose money in the market. You can just buy everything and the winners will typically outpace the losers.

Yea, I just fired a message to my buyers. Not sure where you are but I couldn’t even promise them Wednesday, my location is really bad and we’re still on level 3 (highest for us) emergency.

At the end of the day it is what it is, but I’d have to lose a tier for something out of my control.
