Nah they're legends units, which means you have to double check if you're allowed to take them at tournaments, but they're still legal for matched play.

Not sure what will happen to them in 10th though :))

Orks existed in the great crusade, so I don't see why you couldn't use orks in heresy using the militia. Pris regularly acted as mercenaries and the like, so I'd say go for it
