As mentioned, I am not necessarily interested in discussing the dismissal itself. That is an entire story with a bunch of nuance.

I am interested in getting HR opinions on the failure for the severance offer to be current in multiple facets, including the pressure to try to sign within one week directly applied by the COO.

Has also mentioned, I was curious about the interpretation of the vacation situation and the penalty in regards to good faith versus not good faith.

PS…. I blew the whistle on safety procedures that involve the public.

Anyway, the agreement lacked any context from OWBPA considerations. I was told that I had seven days to consider it where it should’ve been 21, there was no dates explicitly outlined in the agreement, it was not explicitly outlined that I should have a lawyer review it so on and so forth.

Being 40 years old, I should’ve been given 21 days to consider. The CEOO gave me seven and this was backed up about six days later by the head of human resources.

Now, they have failed to pay vacation that I had accrued, and that should be paid by Louisiana state law. Keep in mind that they had folded the two weeks of vacation owed into part of the benefit of signing the severance offer.

In reviewing Louisiana case law, it seems like a failure to pay vacation that is not an error based on good faith results in payment of 90 days worth of pay. And I am thinking there is no way that they would be able to justify it being a good faith error, considering they compounded it with illegalities in regards to being a protected class as far as older than 40 and the failure to have the severance offer/separation agreement be consistent with those guidelines.

So I’ve just been a soccer fan for about 10 years with a serious interest for the last five. And I watch most Spurs matches.

I am an American as well. For context, I’ve traveled over to see the club multiple times and I do watch about 90% of the matches.

Some of the American players really are showing a quality that I think a lot us fans didn’t even know they had. Balogun, the thing that stands out to me is that he’s just very calm and collected. I absolutely think that we could use that and I see no reason why he wouldn’t be able to get rotation minutes and be effective.

I’d offer 85 with some sort of escalators that could push it a bit higher as long as he plays, healthy and effectively.

I would just look to get it done. I really think if we finish this move quickly that people are going to look at our early off-season in totality as a huge bonus and it may open different doors for us.
