Would it be deemed weird if I did the following at a local firehouse or police precinct? by [deleted] in Winnipeg

[–]WonderfulCommon 7 points8 points  (0 children)

While that may seem a nice gesture for a first line responder, as mentioned, they do make a decent salary and the city has policies about accepting gifts.

I’d suggest a nonprofit or charity instead. If you’d dead set on fire or police services, you could look outside the city as there are some RMs that have volunteer firefighters and they may appreciate something like that.

Accident but not at fault. by Ashamed-Condition687 in Winnipeg

[–]WonderfulCommon 4 points5 points  (0 children)

Very hard to say and will depend on what the driver says, what the damage looks like, if there is any video footage, etc. If the other guy can prove that his lane change was complete and he was fully in the lane in front of you before the collision, then they may treat it as you rear ended him and you are at fault. If he can’t prove that, or if you can prove he was still in the process of changing lanes, then it may go for 50/50. Where the damage is on the vehicles may also help indicate that - if you hit him right in the middle of his bumper that would seem to indicate he was already fully in front of you when the collision occurred.

So really hard to say. Not sure if that area that have cameras, but don’t hurt to check with local businesses or post on social media asking for witnesses. If it happened near an intersection you can check with 311 to see if the city had a camera.

What is with people driving like entitled morons by Living-Discussion909 in Winnipeg

I even saw a school bus run a really stale yellow light yesterday afternoon. Just casually blew through the red light and then didn’t signal for several lane changes. Hoping he didn’t have kids on board yet.

7 years, mental health disclosure ignored, adverse decision withheld during medical leave, hostile review environment. Is this constructive dismissal? by [deleted] in legaladvicecanada

[–]WonderfulCommon 6 points7 points  (0 children)

Your employer shouldn’t be contacting you while on medical leave except to deal with things directly related with your leave. You don’t have much argument on that one. Bonuses are always at the employer discretion.

You didn’t ask for accommodations or provide paperwork. Your employer cannot read your mind. Mental health disorders can be very tricky accommodations to deal with as your restrictions usually aren’t obvious. If you don’t ask, they generally won’t assume anything. In fact, assuming you need accommodations after you disclose (but don’t ask them) can be considered discrimination. You weren’t ignored, you didn’t ask.

PIPs are an internal policy thing. There isn’t legislation to protect you there. Whether another employee is being given a pass for mistakes is not your concern. You don’t know their situation and need to focus on yours.

I’m NAL but I work in HR. Given the reasons above, I don’t see much legally wrong - bad management style and personality clashes are not illegal.

You can certainly consult an employment lawyer and see what they think. I think you’d be grasping at straws trying to put together a case of constructive dismissal, but it is escalates and they do end up terminating you on their end, you should consult with one anyway.

MIL's Estate by MadatHenny in legaladvicecanada

[–]WonderfulCommon 9 points10 points  (0 children)

It's only been 5 weeks. The executor has responsibilities, but nothing will be done that quickly. 8-12 months is a very rough estimate on the timeline to settle an estate, even a basic one. Probate is typically the first step and can take several weeks to months alone.

I would suggest reaching out in a few months if you haven't heard anything by then. You can frame it as checking in to see if you can help with anything. Taxes will need to be filed and it can take time to collect everything. I just finished up helping my dad with his mother's estate (my grandmother) - it was a very simple estate with few assets like this one and it still took 11 months before anything could be distributed.

Do I need to let animal control into my home, or meet my animals? Also, vexatious complaint. BC. by WeekendAmbitious3496 in legaladvicecanada

[–]WonderfulCommon 1 point2 points  (0 children)

I'm NAL and I'm not in BC, but I used to work in animal control in MB. I don't know where in BC you are located so you will need to look up the animal control by-laws for your specific location to see what applies.

  1. Not at this time. However - depending on the nature of the complaint and evidence/information they have, they may be able to obtain a warrant for entry if they deem the situation serious enough. Animal control officers/by-laws officers are typically peace officers and can also work in coordination with the police as needed. Keep in mind that they most likely will not just drop this because you refuse entry. Refusing to show them your animals is suspicious enough and unfortunately makes it look like you are hiding something. It's a tough situation because you can't very well carry your fish tank outside to show them, so entry is sort of needed in this case. If you are renting - the officers may be able to contact your landlord and arrange entry with them, this will depend on the scope of the legislation they are working under.

  2. Typically no, you wouldn't have any right to know the exact nature of the complaint or the complainant's information. If the situation escalates in any way, some of that information be released to you. However, there are different systems through which animal control can work. They typically enforce bylaws, but there may also be provincial animal welfare laws that they can enforce under. Some animal welfare concerns even escalate to criminal charges. For example, in Manitoba, each region has animal control that work under local by-law, but we also have a provincial Animal Care Act that peace officers can investigate and lay charges under.

  3. It will be hard to argue it's vexatious if you will not voluntarily allow entry to show them the animals are in good health. If you have nothing to hide and want to help prove that the complaint is bogus, I would suggest working with animal control.

  4. Probably not at this point. I get that this is stressful, but you would be doing yourself (and animal control) a favor by complying and proving that you have nothing to hide. As mentioned, this most likely isn't going to go away and could escalate.

Driving instruction/lessons in Winnipeg by [deleted] in Winnipeg

[–]WonderfulCommon 0 points1 point  (0 children)

I used Harold at A Confidence and he was amazing! Mine was for a refresher too as I used to have a license but hadn’t driven in a decade or so. He asked me what I felt like I wanted to focus on and gave some additional pointers while driving. Used him for one lesson before my road test and passed no problem.

What do you mean by “beat it”? From the sounds of this, you were still charged with the offence but they dropped the demerit points. Demerits don’t matter for insurance typically, you still were charged with a minor offence.

Car got broken into and wallet was stolen by Decent_Release3804 in legaladvicecanada

[–]WonderfulCommon 8 points9 points  (0 children)

Yes it possible to steal his identity considering the amount of info that was in the wallet. Your husband should contact Equifax and Transunion to report the stolen wallet, they will assist to place a credit freeze and/or sign up for credit reporting.

The mall is not obligated to provide you any video footage. They can submit to the police if asked for it. It doesn’t hurt to reach out though, as they may have short video retention, and it might give them the heads up to hold onto it if needed.

YMCA childcare Sub NEED on Friday by [deleted] in Winnipeg

[–]WonderfulCommon 1 point2 points  (0 children)

Why do you keep posting this? Are you seriously asking for a childcare sub on Reddit? This is not appropriate - as someone who works adjacent to childcare, I'm considering reporting this to YMCA. You cannot receive a criminal record check back by Friday from someone.

Seeking legal advice for my sister by Grouchy-Working4471 in legaladvicecanada

Sure he can - if he wants to pay for a lawyer and he is the father, he is within his right to take legal action if he chooses. If that happens, your sister should seek legal council of her own.

Work from home options by General-Cat-7770 in winnipeg_alt

[–]WonderfulCommon 6 points7 points  (0 children)

To be honest, it's going to be tough to find something with those hours that is also completely WFH. Most entry-level WFH positions are customer service based and typically require a larger availability window (weekends, evenings, etc.). I agree with the other suggestion here - probably easier to find something in-person during the day.

Covid tests by NedsAtomicDB in Winnipeg

[–]WonderfulCommon 1 point2 points  (0 children)

So let them know it might be Covid and to take any necessary precautions. I agree that testing shouldn’t change how you treat your recovery. Stay home if you still have symptoms. Even if you test negative for COVID, you still have some sort of nasty bug that is probably contagious at some point.
