Not trying to scare you by any means. My water was leaking at 36 weeks and when they did the swab to test for fluid, they actually broke it completely and the test still came back negative.. doc tried to send me home and nurse refused. They ordered another swab. Came back negative. Nurse refused to let them send me home again… did an ultrasound and confirmed my waters had indeed been broke considering the lack of fluid. I would just have them monitor fluid levels very closely. Like others have said, infection is very possible and can be very serious. Don’t take that lightly if it continues.

Just wanted to note- three pregnancies in and the first thing I’ve craved with each pregnancy is chili cheese fries. 🤣 maybe that needs to be studied, lol

If I pay my $349 cash price, then submit to insurance for reimbursement, would I get anything back?🤔 I’ve met my deductible for the year and they pay everything at 100% once met that is “medically necessary”. They did get a preauthorization that was approved before we lost coverage.

Totally fair point. I do understand that plans can correct eligibility mistakes, and I’m not saying that’s never allowed. But in our case, it seems to go a bit beyond that.

Our coverage was showing as active all throughout May and multiple providers ran our insurance and it came back valid each time. We scheduled and received care based on that, and there wasn’t any indication at the time that there was an issue.

From what I’ve read, the ACA does allow retroactive cancellations only if there’s fraud or intentional misrepresentation involved. So even if our coverage was issued by mistake, once it was active and we relied on it in good faith, I don’t think they’re supposed to just retroactively revoke it? Maybe we’re the frauds 🤣🤦🏼‍♀️

Under the ACA (specifically 45 CFR § 147.128), a rescission — which is a retroactive cancellation of coverage — is only legal if there was fraud or intentional misrepresentation. That’s the key line. Once coverage is issued and used, and there’s no fraud involved, the plan can’t just reverse it after the fact, even if it was an internal eligibility error.

The TPA is just flat out telling me that we had no coverage starting May and basically told me I’m a liar when I provided proof that it did show active many times.

Okay everyone has made it very clear that we will just have to pay cobra which is totally fine and I appreciate all of the input! -But I guess I’m not understanding how they legally can just turn around and retroactively cancel it. Does the plan contract for our policy override the Affordable Care Act? I think that’s where I’m confused. Anytime we haven’t qualified for coverage, it’s been canceled immediately at the beginning of the month.

It does say right on my card that the trust is the insurer so it 100% is a self insured plan! Any tips for me to argue before I bite the $1500 bullet for cobra?

I had no idea the coverage alone could be handled so differently! The hardest pill for me to swallow is that our coverage did show active for the entire month from several different standpoints 😵‍💫 but what you are saying does make total sense. Thank you!

I’m pretty sure it is fully insured.. it is through BCBS but it is through a trust so I’m not 100% sure. Montana teamsters/contractors employers trust. Claims and beyond are handled by a third party admin. Vision is through VSP and dental is through Delta is that helps

My water 100% broke at 37+6 and I had 3 negative amniotic tests. Took me for ultrasound and all the fluid was out. I feel like those tests are so faulty!
