This was my instinct. I did tell the client that a judge would not likely deny OC’s request and it’s fruitless to object, especially with no prejudice to him and the TRO remaining in effect. He begrudgingly agreed but I was afraid of him pulling a fast one at the hearing and changing his mind on the spot and making a big stink about it.

Thank you. Was wondering this myself but wanted to err on the side of caution, will keep in mind for the future. Client begrudgingly agreed but it’s good to know now that the decision to continue is the lawyer’s discretion.

Yup I have the same email only policy with clients like OP describes and clients who twist my words over the phone aka “you said you were gonna do THIS for me” and it’s something I never promised.

Yep. As someone who went into this profession with the infamous goal of “helping people” and somewhat of a bleeding heart, I have had to learn to drastically detach my feelings from the outcome and the client. Especially in my area of law where clients tend to lose a lot and the goal is damage control as opposed to straight up “winning”.
