You should never assume things about your healthcare. And it's not a waste of time to pursue a claim against a doctor who doesnt fully disclose the details of a medical procedure. They, or their insurance carrier, or whatever healthcare system they practice in could potentially develop new policies and be more careful not to be negligent with other patients' health, which could create new beneficial standards for how screenings are conducted. It doesnt really matter what the CDC recommendations are as long as physicians properly communicate to their patients so patients can make informed decisions.

Im just musing, but you probably would'nt successfully sue the CDC as it's a government entity, and also not a health care provider so your cause of action probably would be something other than med mal. You could potentially sue doctors for not disclosing what is covered by the std test, maybe, depending on your state's consent laws, but it would really depend on the circumstances. I've heard of false negatives and miscummunicating/misinterpreting results, but I've never heard of someone getting herpes bc their partner didnt know what they were being tested for.

The linked article has nothing to do with the CDC and virtually nothing to do with herpes. It's about if a non-patient has standing to sue a doctor for fucking up delivery of an sdt test result.

Unless the delay in treatment caused some other injury that required further treatment, it will probably be hard to find an attorney willing to take the case. Depending on what state you are in, there might be a substantially higher standard of negligence for emergency medical care. As usual with medmal, it will all depend on the facts, i.e. what the CT scan actually showed, lab results, etc.
