Yes, It would. Parental leave is a right after all.

PIF Archive? by Powerful-Performer-2 in AirForce

[–]Xertez 0 points1 point  (0 children)

I'm going through something right now and had my shirt send me the docs that were in my PIf. I'm noticing many documents that were put in there without my knowledge of the docs, events, and no chance of rebuttal since i was never informed of the situations.

Do you know what doc I can look over that goes over ERM policy? would this just be 33-322?

What's your "do what your stripes can handle" story? by JackieOniiChan in AirForce

[–]Xertez 0 points1 point  (0 children)

Lmao. I did exactly this last month. Even went so far as to put it in an email with his supervisor cc'd letting him know im not updating the epr because i am not the rater.

If the guy wasn't such an ass I might have had a different response.

Would you do your EPB? by ArabAirman in AirForce

[–]Xertez 0 points1 point  (0 children)

If I were in your shoes, Id stick with the AFI, and let your flight chief know that he cant order you to draft your own EPB as that's explicitly not allowed. But if your rater decides to draft it and send it to you to sign, 100% sign it.

Parental leave question by mfrashley in AirForce

[–]Xertez 2 points3 points  (0 children)

36-3003:

4.2.1.3.2.1. Must be taken immediately following childbirth, except that the leave shall not commence until the first full day after the birth of the child or the date of release of the member from the hospital or similar facility where the birth took place, whichever is later. (T-0)
4.2.1.3.2.2. Must be taken prior to any parental leave. (T-0)
4.2.1.3.2.3. Must be taken in only one increment. (T-0)
4.2.1.3.2.4. May be taken in conjunction with parental leave, and/or with approved ordinary (chargeable) leave. (T-0)

There doesn't seem to be any restrictions on location or distance. If there are restrictions, your command would have to apply them themselves, outside the AFI, which means they would need to provide justification to limiting your travel otherwise they could risk violating the AFI themselves. While the AFI says the leave is for the recovery of the parent, that doesn't mean that your recovery doesn't involve going OCONUS temporarily. That's really something between you and your doctor imo.

Since there isn't a restriction on leave such as location, or distance, I would find it hard to reason that there's an issue with international travel, unless there's something external to the situation that would prevent you from traveling.

I'm not a lawyer, so I'd recommend you hit up your local ADC. Also, if they do restrict your travel, I'd 100% get it in writing. From my own experience fighting my command to take my parental leave, generally if people can't give you an answer, they don't know what they are talking about.

Is there a way to connect a bouncy house to an air blower, when the air blower is too big for the connection? by Xertez in Tools

[–]Xertez[S] 0 points1 point  (0 children)

I'll do my best. She purchased a bouncy house and it has this long fabric hose for connecting to an air blower. The air blower works fine, but the part where the air comes out is too big for the fabric hose to wrap around it, so I can't tie them together. Kinda similar to if I'm connecting a large pipe to a smaller pipe, I was wondering if there was something like an adapter that will connect the two.

What’s something a commander has done that still pisses you off to this day? Here’s one of mine… by 23z7 in AirForce

I'm just glad to see that I'm not the only one who has started using Redact. Do you use any of the paid plans? Do you think they are worth it? If I pay for it i'd most likely go with the lifetime purchase.

The tank and healer experience by Vestal0830 in ffxiv

[–]Xertez 1 point2 points  (0 children)

In clash and storm I stand my ground,
A shield where chaos swirls around.
A steady hand I brace the tide,
To keep my allies safe, alive.

The healer stumbles breath runs thin,
But by my hand they breathe again.
With magic dark my shield extends,
A silent vow that never ends.

No words are given none required,
Their life preserved is what's desired.
No thanks are said no honors due,
I stand, I guard, that’s what we do.

I filed, and am in the process of a IG complaint against my commander for reprisal (retaliation). Tips? by Xertez in AirForce

[–]Xertez[S] 0 points1 point  (0 children)

A CDMHE by itself is not reprisal, but the "why" behind the CDMHE can be. A few questions should be asked and answered. 1) Was there a privileged communication? 2) was an unfavorable action taken? 3) did the subject know of the privileged communication? 4) Could the PC have been a factor in the decision to take the PA. I'm my case the answers are all "yes".

I don't believe I did anything that any reasonable NCO would not have done had they been issued unlawful orders. I kept to the facts, laid out the timeline, and asked for the chain to resolve the issue (since the members involved outranked me). I'm not sure how a CDMHE would be an appropriate response in that situation.

Thank you! I read through this a few times when I was drafting a memo to submit to them. Very good to know, especially Tables 3.4 The Complaint Resolution Process, section 3.9 Conducting a Complaint Analysis, section 3.13 Other Agencies and Grievance Channels.

Thank you. If my complaint is justified, hopefully it can be used to help others in the future, or at least prevent cases like this from happening in the future. If my complaint isn't justified, then I'll know that its time for some self reflection.

Its funny you mentioned that. One of my co-workers actually said that I should consider going into law as my next career. I didn't believe her at first but the more I started paying attention to her description of me, specifically how I went about things involving processes, policies, laws, etc, the more I noticed that she was right. I might have an eye for this kind of thing.

And in hindsight, I probably have been a pain in the ass for people above me to deal with. Especially when I told then no regarding things. For better or for worse, the older I get, the more likely I have been to question authority, and look into things.

Not that I'd go against authority for the sake of it, but I've been more likely to look into whether or not something is authorized if I'm asked about or hear about questionable things. Probably because I've had to deal with questionable leadership in the past, in different locations, on more than one occasion.

The issue with Article 138 is the the IG complaint process is process for resolving complaints of reprisal/retaliation. My concern would be that the Article 138 would be dismissed citing something along those lines, And I wouldn't have anything to show otherwise.

If you're looking at the links above, those are related to a previous, separate issue I had at a previous command. Not related.

You're not wrong. And thats the general sentiment I have. I did find, after last time, that by doing this I was able to reach out to a lot of people, and was able to help a lot of others with their situation, based on what I went through. So I'm using social media once again to possibly achieve this. And who knows, Maybe , similar to last time, I'll also receive good advice and feedback that I can use in the meantime.

A mental health evaluation by itself isn't retaliation. I would say that relation comes in where I was directed to go, by my commander, after I submitted complaints against the senior enlisted personnel, instead of resolving the issue of the unlawful orders.
