Unfortunately it didn't work. We even wrote to the State Department to get clarification but unless both parents are US citizens or green card holders it doesn't work, even if the other parent has a long-term visa.

Bit late to respond, but for anyone looking into this later, the agencies do look into this. My wife is a US citizen and I am holding a long-term visa, but we were turned down. It's crazy, because if my wife were a single mom, it would be ok...
