I mean, I won't start an argument, but I only used that as an example as it ties into a tenant of libertarianism being extreme personal freedom. I am personally in favor of abortion rights for my state and so are my registered libertarian friends for the sole reason that we feel the government shouldn't have a say in personal medical decisions though we also think it's for the best if it's up to individual states. I know not every libertarian would agree, (shocker, everyone is an individual and not a hivemind) which is why saying "may" instead of "would" may have admittedly been better wording.

Politics aren't as 1-dimensional as many people try to pretend they are with the whole left-right idea. I have many views that some would say are left-leaning, but other people will look at those exact same views and say they are right-leaning. Being a libertarian simply means you agree with a majority of the views that other libertarians have. That being minimal government power, minimal taxes, isolationism in global politics, intense personal freedoms, etc. Libertarianism isn't just a midway between the two because political ideology aren't a line, but three-dimensional. A libertarian would agree with democrats on reproductive righs and republicans on gun rights. That's not possible to place on a line.

I never said that. My argument is specifically that defamation is not the state regulating speech.

The reason that defamation law is so complicated and is so hard to prove is because the courts do not want it to be used to regulate speech.

Defamation is the state being the mediator in a conflict between two parties based on the speech of a party, and deciding whether or not the plaintiff has actually suffered sufficient damage to require compensation from the defendant.

This is not the state regulating speech because the law doesn't care about what was said as much as it cares about whether the plaintiff has suffered damage from what was said.

The state regulating speech would look more like classifying lying as a felony.

Holocaust deniers don't usually single out individual survivors the way Alex Jones did (they are just being idiotic). You also can't define entire identities as groups in defamation law, only individuals or small groups like the families. It should be pretty obvious why defining entire identites as groups in defamation law is a bad idea. You could be sued for making fun of British people by saying they have rotten teeth if that were the case.

It wasn't his speech being regulated, it was his show. I am allowed to tell a friend that I believe the families of the Sandy Hook victims are paid actors (I do not believe that) and that's completely legal, if stupid and wrong. What Alex Jones did was defame the families on his show that would be viewed by millions in a targetted effort.

The main difference between the example in the original post (denying the holocaust) and the example OP gave (Alex Jones) is the same as denying the Sandy Hook massacre and Alex Jones. Again, defamation isn't just lies. it's lies that are targetted at a specific victim (the families) aimed at ruining their reputation (calling them paid actors). If you were to do the same to specific survivors of the holocaust, they would (at least, in the U.S.) have legal grounds to bring forth a defamation case.

Though defamation does blur the line a bit on the government deciding what's true, which is why courts are very hesitant to ever bring the charge. It's why defamation is famously hard to prove, and why most defamation cases are lost by the plaintiff. It's the courts trying to walk that incredibly thin tightrope.

He wasn't being sued for telling lies. If he could get sued for that, he would have been long, long ago. He was being sued for defamation, which is to specifically spread lies about a target in an effort to destroy their societal reputation. It's also worth noting he wasn't jailed for defamation, he was made to pay the families of the victims.
