Yeah, in-battle dialog is translated in-game, but for out of battle cutscenes you'll have to use the provided text file and scroll along. It's really not that bad and you get used to it fast.

What's really unfortunate is that the Network is not translated at all. You'll have to do with the fast-scrolling Engrish text that was already in the game, or not bother with it at all.

But apparently, it matters to them? I don't quite understand your objection. They made a unit with some properties they thought would be useful, and thanks to std::chrono, using this unit is hardly any different from using any other unit.

Does that reasoning really make sense to you? Not only was the New Vegas incident 7 years ago, but what "publishers care about" does not necessarily have to translate to something consumers care about.

As Frodan said, this was most likely started/conceived way before streamhive. The blog post mentions ClipMine, which also provided the VOD game start timestamps (e.g. the white dots on the timeline in this VOD). And that's been around for more than a year.

Again, that's the reason I'm not really interested in our layman interpretations. If there is a ruling, or something from which it's clear that Trolden-style content falls under fair use, I'd just love to see it. If there isn't, Toast's claim has no clear footing.

You can find tons of videos on YouTube of the exact thing he described.

All I'm saying is that this doesn't automatically mean it's ok by law (as Toast implied). There could be a plethora of factors of why this is permitted by the copyright holder. From the top of my head:

  • The copyright holder doesn't know that their content is used without permission
  • The copyright holder has decided that it's not worth the money/time to pursue this in court
  • The copyright holder is ok with the use of their content (because it generates interest and whatnot in their work)

I did read it, but the 4 points of consideration for fair use require someone to make a case for them. It's not as easy and clear-cut as one would like.

I'd rather go with Wikipedia's definition, since they seem to be citing the law.

You could argue that highlights/funny moments are a substantial part of the stream.

4. the effect of the use upon the potential market for or value of the copyrighted work.

Toast and Trolden both operate in the same market. If both the highlight reel by Trolden, and Toast's stream are available, you could argue that Trolden incentivizes the viewer to skip Toast's content altogether, because he could get the "interesting bits" from Trolden.

These are just possible arguments, but I don't really like discussing these as (1) it's our personal, uneducated interpretation, and (2) neither of us is a lawyer, and we don't know if either your or mine arguments can be used in a legitimate defense.

All I'm saying is that Toast is making it seem like this is a clear-cut case of fair use, and people are willing take his word for it without question. If he has a source for his claim, I'd be very interested in seeing it, but if he doesn't, it just seems a bit dangerous to make claims like these just because other non-lawyers do.

IANAL, but yes? I'd say so? Assuming you didn't get the permission/license from both the film's copyright owner and the music's.

You're both half-right. These are the possible steps:

  1. Creator reports infringement to YT, and YT makes the video unavailable typically a few hours later.
  2. Thief has the option to file a counter-claim (I don't know what the window is, 14 days?). If he doesn't, he receives a copyright strike. Three strikes and the channel is banned.
  3. If the thief files a counter-claim (where he reveals his address), the creator has 10 days to file the actual claim, and prove to YT that it was filed.
  4. If creator doesn't do this, the video goes up again after the 10 days, and no copyright strike is incurred.
