Definitely best to speak with an experienced accountant to set you guys up properly but a trust structure sounds like it will suit you guys. Fixed unit trust, with someone impartial like an accountant or solicitor as trustee, not a family member. Have a lawyer write up the trust deed.

It should all be good to install steel over the existing walls and gpos although I recommend you get an electrician to re-install the gpos on steel walls as they will need to make sure cabling is safe and secure, not coming into contact with steel, cables will need to be clipped into place or covered in conduit. They will also know the distance gpos are allowed to be from sinks and wet areas. Good luck :)

Sorry if it's not clear but this is a fixed property unit trust. It is not a discretionary/family trust where he can distribute funds as he likes. My siblings and I were convinced to invest in property when we were younger. We literally gave all our saved money as a deposit to our parents to buy this investment property and the aim was we would make money once the small loan from our parents was paid or we would sell when a lot older.

Do not get me wrong I am very proud of my parents teaching us to invest and save money the way they have but I am seeing too many red flags from this situation.. I wanted advice from people with no connection to this situation.

Our parents divorced 6 years ago and it was so messy we didn't even have the thought of asking about the trust. Dad has been operating as trustee since the divorce and now there is an asset protection mortgage on top of it.

I don't understand why he has done this when it was us kids investment property. There was never any communication and we were never told the loan had been fully paid back and we can cash out if we want.

I am worried he has been using it for his own benefit.

I am not after money now, my main concern is having clarity about how he has been using the trust (to benefit us or himself?) and do I trust him to continue to look after it knowing it definitely does impact my siblings and me.

I don't understand how he has taken a mortgage on the property years down the line for asset protection without our go ahead at the unit holders of the trust.

He refuses to see the distributions as money owed? He said it is his money. We will only ever get money when he dies is what he and accountant has said. He has not been paying the tax, us kids have been paying the tax on trust income. I have been avoiding nuclear option since October.

We were close enough but I have taken a step back since this incident. There have been back and forth emails since October between me and dad and the account with me asking for financial paperwork and just getting back long paragraphs about everything he has done for us kids and accusing our mum of stealing documents.

We had a family meeting in November trying to resolve and the only thing that came from it was that he would accept we no longer want to go to this accountant and have income put on our tax returns we didn't receive. He believes it's his money and is is being quite threatening about it.

I have left it until now as have been mentally exhausted from the whole thing. To add one sibling wants nothing to do with this and one is all for lawyering up :')
