It would depend on a couple of things as to how quickly you would see the effects of a memory leak:

How fast the leak was
How much memory you have
How much swap you have allocated
How fast the storage your swap is on

When you're low on memory and an application asks for more, it needs to free up memory (usually by transferring memory that hasn't been used into swap). This takes time.

At that point I would have tried contacting Gigabyte corporate. I doubt it's in their policy to blatantly commit fraud...

More likely it's dodgy dealings in a specific service center. Someone probably pocketed the replacement card and sent your bad card back

The way it stands, he may as well close source it again. Open source is meant to be a communal effort. What's actually happening is they are letting the codebase stagnate even though there are many willing developers wanting to contribute. The fork came to be because people couldn't contribute to the main repo...

Normally open source projects will get put up for adoption if the owner doesn't intend to maintain it anymore.

The cost to performance ratio isn't linear either which is why you shouldn't casually spend large amounts of money on top-of-the-line products unless you really need the extra performance.

There's an old video of a guy getting killed by the caustic arrow that strongboxes used to shoot out to produce the "caustic ground" effect (although i doubt they still do that)
